Workman’s comp stuff
 
Few days my wife hurt her back on the job. Filed a workman’s comp case. Company took her to the company dr. Took xrays, glanced around them and said there’s nothing wrong. Now I know and she knows there’s a serious injury going on. She can hardly stand up due to the pain. Her employer said they’ll write her up if she sees her dr for 2nd opinion, which to me sounds odd. If it were me I’d go see my dr anyway And call their bluff. I don’t even want to bring the L word into the picture but seems like it’s going that way already not even a week in.

Ya I’m surprised this place is Still in business. It’s a food place with horrible management. They throw away more Product than they process. Coincidentally her comp dr was the same as the company that I worked at. I cannot believe that this dr doesn’t have a malpractice lawsuit. I remember hearing guys at my work who got their hand mangled and this dr says it’s ok go back to work. I mean like mangled broken from going through the gears of a Hydraulic machine.

We shall see how all this goes. She’s afraid of pissing a manager off. I light just have a buddy call the hr and start asking questions to get them scared into submission

FORGET about pissing anyone off, this is serious business .

My first hernia was on the job and the quack they sent me to changed his diagnosis the instant he discovered I was going to use a different non quack doctor, suddenly saying I was fine to go back to work when I couldn't even breathe deeply for the pain .

Then I had to go the state's appeal board, more quackery ensued but I refused to give up so after a while they relented and I got the surgery .

Your wife's back is more important than any one / thing else, I've been there and done that ~ get it fixed ASAP before more damage occurs .

Apparently these days they pretty much automatically deny all claims at first .

Denial of claims initially has been common for years. Claims in Canada raise the employers premiums. For work mans compensation.


Hopefully your wife has no spine damage. You cannot tell a patient there is no issue just by observing an xray anyways. Pulled muscles and other issues can be the cause of the pain.


Here in Canada a policy of blue cross is to arbitrarily suspend benefits. Simply because they have found out most people will not sue.

Did you try to change your citizenship to just south of our boarder? Then you get free health care, free education to take you to an easier position somewhere else.

I been trying to get her to see a real dr. She refuses. Says the company said she had to wait 30 days and she signed some stuFf last year. I dunno. There’s a lot of doctors in the area that’ll take cash and no paperwork. Was trying to get her to see a dr off the books to Take an X-ray and at least give her a straight answer on stuff without putting osha into the picture. I wish she would put her needs above what the company says.

Needs to see another Doctor, or a real Doctor quick. Like PDQ. She could be damaging her back more. I will say that the Company I work for take these things seriously. Any pain should be checked out.

Unfortunately, workmen's comp has morphed into a system that doesn't seem to work for anyone. over the years, people, family and associates have told me horror story after horror story regarding workmen's comp.

It is time to get a top rated workmen's comp lawyer involved. If you don't, your wife is going to continue to get screwed over. Remember, neither you nor she can put a dollar amount on her health.

Wise words. Without reasonable health you have nothing. The illness or problem dominates everything.

An x-ray can only reveal of there is a fracture. Likely she needs an MRI. ASAP.

Whatever she signed should not preclude her from getting legitimate medical care to treat a serious injury. Get care first, worry about the WC aspect later. You should also talk to a WC attorney; I think they most all work on a contingency so it should not set you back any $$.

Diagnostic imaging is your wife's friend. MRI, Cat Scan, X-ray, etc. a picture is worth a THOUSAND words. A WC lawyer can then send nasty grams to the workmen's compensation insurance carrier letting them know they best pay up or we'll see you in court.

BTW, there is an art and a science to writing a GREAT nasty gram. The other side has to FEEL THE PAIN or else they won't lift a finger.

Ya I haven’t been able to convince her to take action. Everyday I try to get her to go down to the attorney’s. She can barely walk And the company is treating it as a papercut to avoid osha doing an investigation. I’m sure they’ll get fined. They still have her walking all over the place lifting things. Normal work. From what i understand the equipment that she got hurt on has also injured 2 other people in the same way. There’s been a reports for Faulty equipment repair over the last year or so and they haven’t even thought about sending Maintenance on it.

Sounds like a tough position. I have a friend plus family that have suffered injuries. My friend was injured on the job due to no safety training for a machine he was working on. The manual said two people were required to properly man the machine; the other employee had quit two weeks earlier. My friend was tired the night he was injured. Said had the accident happened a minute or so later he would have died. Prior to his accident, the company had not performed ANY training for safely operating the machine properly. Apparently, OSHA was never notified of any of the mess.

His lawyer 'settled' (did NOT litigate, did NOT file a lawsuit, just sent a 'settlement offer' to the workmen's comp insurance company) for a very low amount of money. My friend sustained life long injuries and I believe his lawyer simply didn't want to do any real work on the matter.

Ditto for family members. They were rear ended by a semi tractor truck and came within inches of death. The lazy lazy law firm they hired ALSO presented a 'settlement offer'; they were either afraid or too lazy to file an actual real world law suit.

I'd say only around 1 in 100 lawyers are willing to file a lawsuit and litigate like a tiger. The other 99 are settlement pussies.

BTW, some lawyers will come to your house, you just have to ask. The deal is this; your wife will wake up five years from now with no money and no way to work. Victims have to stand up and fight for themselves in this world, otherwise the insurance companies get to KEEP THE MONEY.

A lil update. Wife had to wait 6 weeks for a mri which determined a bulging disc. This is after the initial X-ray saying there was no issues it was just a pulled muscle. They sent her to physical therapy for the pulled muscle and put her I do much pain. Thy prescribed about a dozen of pain meds and muscle relaxers which were useless. Finally last week she was able to see an actual back specialist which determined there was 2 buldging disc. Doesn’t know why the company dr didn’t see it in the X-ray. Said It’s clearly there. Still to this day no treatment

All this time, all this waste of resources they could’ve put some effort into an actual diagnosis and get proper treatment from day one.

Your wife needs to see a neurosurgeon PRONTO. Tell her to bring the MRI showing the bulging discs to the appointment. Based on the MRI, the neurosurgeon may or may not recommend surgery. ANY back issue has the potential to negatively impact your wife's quality of life long term. After dealing with more than a few workman's comp cases, I'm convinced workman's comp insurance companies do everything they can to minimize their costs $$$$$$.

I've got a message for these insurance vultures; pay to have a competent neurosurgeon look at my wife's medical condition NOW or get ready to meet my lawyer down at the court house. If they think for one minute you aren't willing to lawyer up and take them to the mat they will continue to stone wall. It is just the nature of insurance companies.

I HIGHLY recommend you and your wife purchase this book. Your eyes will begin to open to just how greedy these people really are. Also, be particular choosey when choosing a lawyer. You want a lawyer that has experience dealing with these types of vultures. This isn't the time to hire a newby, you need RAMBO.
