My mom bought a brand new handa accord. With less than two mounth of driving on and with less than 600 miles on the odomater she was rear ended. The turnk is deformed and the turnk will not close.

She obviously does not just want to get it fix. Since for all pritical purposes it is a new car want the insurance company to buy her a new honda a trade it with her.

Doe anyone have any experience dealing with this kind of problem.

It depends on the policy. Does she have gap insurance? Take a good look at the policy and see if she does. Most of the time you are required by the leasing company to carry gap insurance. If she purchased it, then that's another story. She may or may not have it.

good luck, insurance companies have a whole fleet of legalities and attorneys to make it so that you will be stuck with a fixed car.

the only way your mother would be able to collect on the insured premium to buy another car (granted she more than likely will only receive fair market value for the car, which usually is less than your sticker price) would be if the car was totaled, frame damage to make it a salvage title.

the only other alternative for her is to sue the other party after the insurance companies have settled...(make sure to read the paperwork thoroughly from the other parties insurance, so as to not release your right to sue the other party)

My parents seem to have the same luck when it comes to new cars.

Here is something they have done regularly that doesn't cost too much. If the Insurance company doesn't replace your car then take the maximum amount they will pay out to repair the car.

Then go to the dealership and ask them how much it will cost to trade in the car as is. They usually don't subtract the full amount of the damages from the cars value since they get parts at cost and have connections with body shops. You get a new car and they repair the old one. The money recieved by the Insurance company goes toward paying the difference. You will lose a little money but nothing significant.

What you can do is figure out the "dimished value" of the car after the repair and make the insurance company pays you for the loss value becuase of the damage to the car. This will require some legwork on your part or perhaps it would be worth it to consult with a lawyer for this.

There are alot of threads going around in regards to this topic. If you do a search I'm sure you will find more information. In fact, there is a very similar incident (either on this board or on benzsport.com) in which a member just purchase a low milage used AMG and then got re-ended on the freeway.
