Got STIFFED by a David Fracalosy of Corona Del Mar, Ca.

Got a bad check from this person:

David Fracalosy
Hottee18m@aol.com

Guy buys my corner lights from my 202.. cant wait to get them.. I charge this A**HOLE $20.00 + $14.00 ( UPS) = $34.00. I tell him to pay me once he gets them to make sure I sold him what I said I was sending.. Get his check and he doesn't have the $34.00 in his account plus I get tagged for $15.00 for a bad check charge thing.
So I am out $49.00 + the lenses. I sent this guy a e mail asking for my money but guess what?? No reply. Talk to his "freind" and tell him to send me a e mail.. No reply. Beware of this guy.. To me it is about the principal of it and not the money.

EDIT: Sorry I removed his personal information but left his name and e-mail. I don't think anyone here, even you, would appreciate your address posted on the internet. I also removed the threat part but left the information of the post.

It Would be Best to Contact the Newport Beach police re this and File a Complaint With the Bad check Department ...You Can Collect three times the amount of the NSF check
Please save all of your E mails from him and make copies of the check front and back..along with your bank statement
Do it The legal way..Its/he Is NOT worth the hassle of Going to jail for This Fool! For $50.00!!

Use Ebay...

This is yet another reason to use ebay for your transactions. Ebay requires a credit card number, and, at least in theory, a real name and address of a real person. Armed with more information like this, you can better chase down and prosecute the rip off artists.

As mentioned before, though, be legal about it and who knows, you might even wind up with more money.

Keep trying to contact David...most of us "know" him as David C Klass on this forum. While I've only met him once in person, I don't think he'd intentionally try to cheat you. There must be a reason...

Paypal is always good . I had somebody not deliver the goods after I paid. They (Paypal) refunded the money back to my account, or credit card, whichever it was.

I find it hard to believe that David C Klasse would rip you off. He is a very long time contributor to this forum (unlike yourself). Besides, he doesn't seem short of a bob or two. Just because the problem hasn't been resolved instantly upon the sending of an e-mail, it doesn't mean this isn't a misunderstanding...

I post a Benzsport where he found me. I have sent him a e mail and told him what I need. If he keeps having time to post here and not reply to my e mail then I think that sends a clear enough message to me.. I am glad that people think highly of him.. I don't. I have a bad check sitting here and want to be paid. One way on another I will be paid for my stuff. So if you like this guy then maybe one of you can suggest the stiffing the Benz community is not the best thing to do.

I would like to make a couple of points here.

1. this should really be taken to e-mail.

2. I personally do not buy things I can't pay for, but I also do not send things to people, unless I have been paid for what I sold first. If I recieved a check for something, if it didn't clear, I would not send the item. If the buyer has a problem with that, then too bad, the buyer doesn't need my item then.

I am tempted to delete this thread, and will only do so if others complain that they feel it is out of place.

I don't feel that making threats will get you anywhere. I lost a best friend recently because he made threats to my girlfriend. It was a hard decision to make, choosing my girlfriend over one of my best friends, but I did what I had to do even though I would rather have not. I don't regret it, but I am sure my friend does. The threats he left are enough for my girlfriend to be able to get him arrested, but she isn't going to unless he makes any more than he already has.

I hope you get things worked out. I would try calling David, and telling him you are giving him a few days to make good on it, before you go ahead and do what some others have suggested.

I haven't seen david post here for a little while, but then again, I haven't been around much lately.

I agree-post should be removed

After reading the assorted threats I also feel that the posts should be removed.
Some clear-headed advice has been given by a number of members.

I think the post should stay, minus the threat.

Dan the AMG man has been defrauded by a frequent participant of this site. I don't care where the transaction took place. If someone is not paying for items, members on this site should know about it so that they can think twice before selling to David or anyone else who doesn't pay. It's called theft.

I hope that it is an unfortunate mistake on David's part, and that he should make good on the money, plus the $15 fee for the bounced check.

Threats have no place on this forum, though.

Alon, I have no opinion on whether the thread should stay. I do however, want to thank you for asking opinions on whether the thread should stay or be removed. I wish another unnamed moderator at this site would be so considerate!

david hasn't been around lately and i remember his last posts had to do with his personal life. i'd say that he's going through some rough waters from the content of those last posts. come on guys, he's all of 19. who knows what could be going on for this to happen?

Personal problems are interesting, but nothing is an excuse for theft. Buying something without paying is theft.
