Why is ticket scalping illegal?

Sadly, scapling is not illegal in Arizona, making it rather difficult to get decent tickets to sporting events without paying considerably more than the face value of the ticket. When the Diamondbacks were in the World Series a couple of years ago, scalpers were employing homeless people to wait in line for hours or even days to purchase all the tickets they could, then turning around and selling them to the public at grossly inflated prices.

Aside from the methods used in acquiring tickets, what's illegal about my purchasing something at a certain price and then reselling to the highest bidder?

Basically nothing unless supply is limited or if the practice limits supply. Think of it in terms of prescription drugs for those on a fixed income or water in Ethiopia.

because big organisations that already robbed the taxpayers of $millions (or, as is the case in Philthydelphia - $billions) cannot rob you of even more. Same reason why, if you download a song off the internet, the company making $billions will sue you.

I agree it is capitalism at it's worst(or best). But if Enron can buy and sell energy, why can't a person buy and sell a ticket? Water or energy are essential components of life so a market in them seems much more problematic than a market in sporting event tickets.

I get it now. Thanks Narwhal. I understand the concept of exclusive rights. I was always under the impression that what I was buying was some physical space where I can sit my butt down for a certain length of time and that it was mine to do as I wish whether I wanted to watch the game or fart in it. I guess not.
I suppose if I want to let my cousin use that space then my cousin has to enter into separate contract with whoever controls that space. Kinda like leasing an apartment and trying to sublease it to someone else for more money.
