My first accident with another car today!

Well this morning I woke up to a rainiy day. I went into Daytona for school and on the whay there got rear ended. It was wet out and the truck in front of me stopped quick and missed hitting it and then a Honda Accord slamed into the back of me.
Cops showed like a half hour after they were called ticketed the other driver and let me leave.
Everyone was ok but the Honda had to be towed away because it lost all of its coolant.
This leaves me with the question
Do I call his insurance or mine?
Do I pay a deductable if it was not my fault?
Will this hurt my insurance premiums?
BTW
I was driving the Van because I' working in the brakes in the BMW. Probably a good thing since hitting the truck would have totalled my car.
Here are some pics

if the other guy got the ticket, his insurance should cover your repair.

no need to get your insurance company involved. you will be contacted by his insurance company, and they will ask you to take it somewhere for estimates. this is your choice, pick the priciest one in town. next, they will send their estimator to look at your car. he will then give you his number. hopefully his number and what you got from your bodyshop will be similar. they will then call you with a number that is mutually fair. usually it will be between the various estimates because of differences in parts costs, etc.

if you agree with this number, they will send you a waiver form to sign. basically it is an agreement that says they will give you X amount and that the case is settled. you can't come back for more unless there is hidden damage. you sign it. they send you a check and you get the car repaired. bingo.

your insurance premium should not increase because you were not at fault. theoretically.

Bad advice. You should notify your carrier asap. Check your policy and find out what the reporting requirements, if any, there are in the "fine print." Failure to notify your own carrier could jeopardize your coverage, including not having your carrier do a repair estimate and then duke it out with the other insurance company over repair costs and the type of repairs done. Further, if for some reason the other guy sues you later on, your insurance company may claim that your failure to give them notice is a breach of the insurance contract and you could be defending a lawsuit, whether frivilous or not, on your own dime.

MTI is right on. Notify your insurer ASAP.

-----------------------------

Also, as a side note not related to this, many insurers are beginning to raise people's rates even if they weren't at fault in a claim. Any sort of claim could precipitate a rise in rates.

Someone recently pushed in the front driver's fender of my wife's 1995 E320 wagon -- hit and run. I spoke with my insurance company (I had $250 deductibles) about this, and they told me that if I filed a no-fault claim, and then filed another claim or two in a short amount of time (if something else were to happen -- my fault or not) they would seriously consider dropping me.

In any case, they said they WOULD raise my rates for any sort of claim -- even though this was hit and run.

Needless to say, I paid $250 for a new factory fender and $350 to have it painted and matched by a competent body shop, all myself and didn't bother filing a claim.

THe next thing I did was raise my deductibles as high as I could. And cursed at all the money I had wasted over the years for having low deductibles, that aren't worth the paper they're written on. Just an excuse for the insurers to charge you more money.

Cheers,
Gerry

BENZMAN500 I thought you had already had an accident. Didn't you skid off a wet road last year, hit a parked car and end up in a ditch?
