This shouldn't be hard. The Census Bureau has been asking many of these questions on their long form for the last fifty years.

It's okay if Obama does it.

Would it be okay if a modern-day Richard Nixon does it?

We should structure or thinking not about when a good guy is in office, but when a bad guy is in office.

Every tool we give a good guy will eventually be in the hands of a bad guy.

Would you care to stick to the point? Does it not give you some trepidation to think of a bad president assuming the powers and tools we have given to good presidents?

That is a good point. I remember the terror the Republicans felt when they realized the Permanent Republican Majority that Karl Rove had promised them was not to be. When they understood the powers they had given to G. W. Bush were now in the hands of a Democrat there was a bit of a scramble to rein in some of the powers they thought they had given Bush.

The point that I was driving at in my usual semi-oblique manner, is that regardless of the limits we place on ourselves as individuals or as our government, every tool we give a good guy will indeed be in the hands of a bad guy at some point – and no one has the appetite to effectively address that inevitability because we all self-identify as the “good guy”, and want the power enabled by those tools to be in our arsenal. We can attempt to address your concern by eviscerating the laws and policies which provide the power and authority to allow a “bad” president to function. Once paralysis has been induced on the office, who determines when it should be reversed? Your bad president may be my good president, or vice-versa.

Yep, that's the conundrum.

Wonderfully illustrated by the "War Powers Act", originally passed in an effort to give flexibility under sudden nuclear attack. Since then it's use has expanded to Reagan in Granada and Lebanon, Clinton in Kosovo, etc. Many presidential candidates have opposed until they got power but then used once in office.

Minor power wielding is not a threat to the republic. Engaging in foreign military and clandestine or covert violence without prior public approval by congress is extremely dangerous. But most presidents since Truman do it. It's freaking crazy.
