Depends on the jurisdiction. The "stand your ground" statute provides an affirmative defense, which places the burden of proof on the accused. The standard of proof can be "by a preponderance" or "clear and convincing" but it is always lower than the "beyond a reasonable doubt" standard that the prosecution must meet.

Sorry, my mistake. I did not post the entire law as I was just showing the portion that placed limitations on the law which the FL law does not posses.

Here is the Wiki link that has the text of of stand you ground laws from various states. Most seem to be predicated on forcible entry.

I'll take up the second part of your comment, can we all agree that when a news agency cuts and pastes audio or video reporting its a bad thing?

I believe it's disingenuous to claim that it's not "political" when only one side of the political spectrum is being accused, which is MS Fowler's habit . . . isn't that bias in itself? So yes, calling out only one side is nothing more than trying to score points under the cover of trying to appear "neutral" or unbiased. He might have succeeded, had it not been for the multiple "media bias" threads he has attempted in the past.

As for editing, I agree that if the editors intent is to purposefully mislead or slant a story or event, then the news consuming public is being dis served and the new organization is being unprofessional.

However, there is still a duty of the public to be skeptical, to challenge and to be informed through multiple sources. If we allow news organizations to make decisions of "truth" and "fact" then we have betrayed our own responsibilities as citizens.

How is it disingenuous to point out errors and bias? On this forum the majority seem to be of the liberal/Progressive bent who refuse to believe that there might be a bias on the part of the media. I am simply the stone in their shoe to remind them that there is another side to the argument. The liberal/progressive don't need me to show them where Fox might be biased. I am the balance. You should also note that I do not reject the idea that Fox might have a bias, too. bias. Neither do I defend Fox's

In addition to NBC's creative editing, now it appears that one of the other networks altered video to disguise wounds on Zimmerman. I am waiting to see some further clarification and verification of that, but if true, it would be yet another piece of evidence that the media were looking for a story that fit some agenda, and then massaged this one to fit. Have you ever heard the term "White Hispanic" before? I haven't.

How many times do we have to debate "media bias" as if it's a new or unheard of concept in the history of journalism? I don't believe anyone denies that it has and always will exist, particularly when one of the objectives of journalism in the modern world is to sell, either commercial products or subscribers of like mindedness.

Frankly, it's your feigned "shock and surprise" outrage that reminds me of the scene from Casablanca . . . you know, the closing of Rick's . . .

I think any enterprise that relies on human input and decision making is going to reflect bias and it's universal to the left, right and center.

If you have ever been interviewed by the media you will know that you are seldom quoted in full.

You just hope they spell your name right and don't make you appear to say something the opposite from your intent when it is aired.

Yes, I have heard the term 'White Hispanic' before. I actualy do support your intended view though. Hispanic is a very wide term. Also, latino is as such. Its such a large and diverse culture. Some Hispanics look white and are basically white. Hispanic is basically, lands controlled or formally controlled by Spain or Portugul. The 'higher' classes usually have lighter skin. I'd say more looking like Itialians or such. Then again some have blond hair blue eyes. look at Brazil. There is even a class struggle, that people look to white, as then they don't or won't get government funded college tuition.
I do think so far this case is being tried in the public. Simular to the Duke LaCross players. I don't know what happened. Wasn't there. Still, more evidence will be needed to convict. I think OJ was/is guilty. Still, I don't know if I could convict him with the evidence that was presented. It was just to tainted.

If it were just the normal personal bias of different people, wouldn't you expect the distribution to fall along a bell-shaped curve?
