$100k LEMON
 
hey guys... we bought a 03 sl500 brand new from GLOBE MOTOR CAR in new jersey.... it was a leftover and was bought this past march... as soon as we left teh lot.. the SRS light came on... brought it back to the dealer... stayed there for 15 days... could not solve prob.. they called techs from MB.. prob appeared to be solved...

about 15 days after.... we got the car.. drove around for a few hundred miles and problem occured again... went in for the same prob.. except this time.. the brake lights and ABS lights were on as well..

car was given back to us... my son was driving the car and brakes failed... as he states " brake pedal went down to the floor with no effort and kicked back up with no feel in brake" in an effort to redirect the car from teh path of a tractor trailer he went into the grass median ultimately running over a truck rim and tire..

car had over 10k in damage.. dealer repaired.... car came back 3 months later... next day after the car was picked up .. srs light came back on .. along with the same brake problem...


well now.. the car has been at teh dealer for 3 months... they allowed us to select a new car... we ordered it.. the car is in.. but now they want me to trade the 03 in .. for a value of 60k and buy the 05 at full price... initially they were swapping the cars... whats teh deal.. anyone know of the lemon law in NJ??? am i entitled to anything???

dealer offered to take back the car and wash out the remainder of my loan to MB CREDIT.. however.. i will be at a loss of 35k from my pocket...

what can i do...

"they allowed us to select a new car" ?? A dealership will always allow you to select a new car - it's what they do. "But now they want me to trade the 03 in.... for 60k... initially they were swapping cars" ???? You didn't get any of this in writing? You thought you were dealing with a church? I suspect you're screwed. Perhaps some verbal committments can be considered binding. But in any case you need an attorney - not ShopForum.

at 100k i'd have me a lawyer and the sooner the lawsuit begins the sooner your problem will be over.

Contact a lawyer asap you should be able to get them to take back the "Lemon"
and give you a FULL refund don't settle for less.

The lawyer is a good idea. Also pursue your state’s lemon laws. Ultimately your claim will be against MBUSA. Put together documents on time out of service, nature of repairs and so forth. I don’t know if the accident related issues will be included. I understand that you say the accident was due to a defect but you don’t say if that was proven. Anyway, again, lemon law. Be very patient and persistent. I went through this with a non MB vehicle and it is a PITA, but once you prevail you will get a pro-rated refund, based on mileage.

From what I've read at this site over the years, MB is good about stepping up to the plate once the case is made.
