When the vehicle was manufactured, the Federal government has a test that is run on a chassis dynamomenter and the vehicle must pass this test or it is not certified.

New York State has come up with its own test with a different cycle (much shorter) and they have their own limits.

It is not feasible to attempt to prove that the NYS test is not valid. You would need reams of data and it would cost you a fortune. Just another deal where the state is trying to make owners of older vehicles get rid of them.

I'm sure the van could pass their test if the engine and the catalyst were brand new. But, it has 120K on the clock and it's no easy task anymore.
