R.I.P.-1985 Mercedes Benz 300d (kitten)

Manufactered August 11,1984,delivery date December 13,1984

Date and time of loss October 27,2004 at 2:50 p.m.

By an unlicensed,no permit,no insurance female 17 year old girl who had a16 year old female passenger who made the decision of chasing another truck through a school parking lot and came out of that parking lot without stopping into a 4 lane street.She cleared the 2 south bound lanes and I was 1st north.I had no where to go.I hit the passenger side and went with the truck to toss it a full 360 degrees where its roof did not touch the ground.I ended up on my sideall the way across with the undercarriage of her truck at my passenger side.I looked over and her drive shaft was still going.I got out of my car right leg couldnt bend and ran over to hers and turned her engine off.I looked at my front which is now draining diesel and oil (bleeding).


I refused ambulance and as the pictured in newspaper just stayed with my baby until she was placed as evidence in police impound.

Adjusters went out to it and body work is sitting at $6600 in parts and labor
not counting engine and transmission.

Deemed total loss


NOT TOTAL LOSS-

I was examined and had a bruised leg and knee.No scratches,cuts nothing.Driver had a cut finger and her passenger who my front end met first hurt her elbow(not even broke it)

No real serious injuries or death that should have occurred.

Did her job and did it well.The car did not break any windows or winshield and it looks like just the hood and grill were messed up.Until you try opening the other doors.They do not open any more.The frame and cage absorbed the energy.Nothing went into slow motion like the car accident I was involved in high school 20 years ago.


It appears the father had just got her this truck at the end of August (since he wasn't paying child support since she is residing with her now).Very little money down on it (they did not even make the first payment).Carried minimum insurance and she was not listed on policy or living in his house.


Mother and stepfather want nothing to do with it and went ape**** over it.Finally someone who has the right reaction. I am well insured and it looks like (I do drive by their house since his insurance has disconnected phone numbers etc. on policy) and a 2003 Chevy Silverado has taken its place.


Pretty damn state of affairs. Since this could have been my children I called the passenger up and spoke with a family member to see if she was o.k.She went to the hospital and bruised her arm up.They were concerned about me as well,that was nice and showed common decency as a human being.

The driver not even a call and I remember seeing a man in his mid to late 40s at the time in the storage yard trying to retrieve a truck .I thought he was from Nissan of Bakersfield -dressed nicely looked over at me and a family member smiled and put his head down and was advised that the truck is on a 30 day hold by the police department-looked again at me with a frown and left.

Make no mistake we will meet again real soon.I am armed already with lawyers,district attorneys and even his own insurance company.I have to know one thing.


Why in the hell do you give your kid access (remember on payments so not bought) to a brand new truck without the benefit of a learners permit and license and insurance? You see if she had those things and did not stop at the parking lot exit ,that maybe considered an accident since she would have been trained and have the knowledge that being 17 a 16 year old passenger is a no no.That could expplain why campus security was running to the scene and the trucks.Since it appears you are licensed,all of the above leads to one conclusion.

You are the most irresponsible parent I have ever encountered who shows no remorse or responsiblity over your child both well being and financially.


You are now being pursued in every way known to man including removal of all children from your home and custody.Financially you will be mine as well the mother and stepfather (pending review of child support orders etc.acknowleding this vehicle).

This is being done to make damn sure that any body under 18 years old anywhere has no business behind the wheel of brand new ( no license plates) vehicle without proper training and responsibilty and will not hurt ,mame,kill or destroy others either outside of it or inside of it or themselves.

Sorry to ramble on (still a little shaken and pissed) by again this was not an accident,it was something avoidable and will be pursued.

I am hopefully picking up another 1985 300 d tomorrow (pending Enrique's o.k.) and we are looking at getting a 2005 320 tdi (lawyers say if it has 6000 miles or more its considered used and can be registered in California).

Human life and safety is not a total loss.

sorry to hear about the car, at least everyones ok thats what matters. Just shows what great cars these Mercedes are. Good luck with the legal aspect of it, and with a nice new CDI :D .

I'm sorry to hear of your misfortune. In GA, insurance follows the car and is responsible no matter who is driving. Hopefully, your state has a similar law.

I know around the Savannah area there are a lot of underage drivers running around with no license or insurance. Some of these kids aren't even old enough to get a learners permit. Sometimes I think with the conjested traffic, it would still be worth it to endure even more wait for some pop-up road checks.

Whatever you do DON'T let them off the hook, garnish their wages get Court Judgement against them..... Make them struggle to repay you with interest, and then they will learn a lesson about life. You are responsidle for your actions, and your actions can and do have consequenses. Sounds like that was a spoiled brat whose parents followed Dr. Spock and not common sense.

Good to hear that everyone was okay, although it's sad to see another M-B bite the dust. At least she died valiantly, eh? :)

Based on that, it sounds like this all happened in the Bakersfield area...I'm almost afraid to ask what part of the city this all happened in? My girlfriend was born and raised there, so I've become somewhat acquainted with the city over the past 4 years...

That said, when I saw where you were, I wasn't surprised by this...and, like others have said, don't relent until you're as close to perfectly satisfied as physically possible.
