2005 cdi spotted on long island

Hello forum members,
I was returning from a visit to Brooklyn yesterday, I pulled over in Roslyn to mail a letter and pulled behind a CDI that had new york plates on it. It turned out to be a 2005 CDI, what gives, I had tought that no diesels 2003 or newer where not to be registerd in ny until mid of this year. does any body know what the regs are?
