Buyer of my 78 300cd ,racking up parking tickets in California.

I recently recognized it on ebay for sell last week ,today I recieved a citiation from the city of Santa Ana about this vehicle on a parking violation .Goes up from $53 to $101 in 2 weeks if not paid.Im guessing the guy didnt get it registered .Any remedies you fellows have.

I left a set of plates on a car that I sold. I got a notice of a parking ticket on a different car, but with my plates. I simply called the number on the notice and told them that I did not ever own the car in question, and had sold the car that belonged to the plates. They then simply dropped the charges. I didn't even have to appear.

I will never leave plates on a car again. I'm sure that you won't either.

In TX there is a form the seller submits to the DOT to protect against this kind of thing....

Do you have a copy of the release of liability form you should have submitted when you sold the car? I don't know what the DMV does with those forms because I know of 3 cases, one including myself, in which registration renewals were received for a car that was sold to a private party.

Do you have a bill of sale or copy of the transferred title signed and dated by the buyer? Try mailing in a copy with the citation.

And mail in another release of liability form - http://www.dmv.ca.gov/forms/reg/reg138.pdf This form isn't signed by the buyer so I don't know how it will hold in court.

Did the buyer pay by cashier's check or money order? Did you make a bank deposit that corresponds with the sale price?

There is a document that you fill out and send to the DMV when you sell a car. It releases you from liability, etc.

That liability release form is, on a CA title, attached to the title itself. You have like 5 days from sale date to mail it. I would go ahead and mail one in to the DMV anyway; if you know the buyers address make sure and fill it in. That was important, I recall. Send a copy to the office sending you the tickets.

You as the seller have the obligation to provide all the information in a timely manner. Sorry to sound like a DMV employee there, but believe me, I have heard all this b4. Nip this in the bud now, or they will nip you.

Wow you guys are trusting. Whenever I sell the car I take the plates off before the new owner drives away. Or in the case of my SD since the new owner lived close to me I drove it over her house and took the plates off.

In some states like Washington, the plates are transferrable, but in Arizona, they are not. However, you should have filled out a sellers report of sale!

In CA the plates stay with the car, not an option to keep them.

Go to the DMV information window and ask them as there used to be a form that you sent in saying that the car was sold and you were no longer liable. (I live in Long Beach, CA.)
Also they have a website you might be able to find instructions there.
