Help 98 mi320 with shifting problems.

I know this has been covered, but I am having an annoying (Very annoying) problem with my ml 320. Most of the time it runs great, but as it gets warm, it goes into creep home mode but only after parking.
I checked the code, there was only 1 (TCM Failure). I don't believe this is correct beacause if the TCM was bad, it should always be bad. But most of the time the truck runs fine. The check engine light does come on, but after sitting for awhile, the trans starts shifting and eventually the light goes out.
The trans has recently been serviced, and like I mentioned, the truck runs fine most of the time.
I do know from reading the forum that there is a problem with the gear location switch, but does it give it's own code or does it show up as a TCM failure?
