Kennedy told the cops he believed he was going to a vote. There is a provision in the Constituion that states that senators and representatives cannot be detained on their way to a vote except in certain specific instances. The instances, as I recall, are treason, commission of a felony, and breach of the peace.
You might think that they could have detained him on the breach of the peace provision if not the felony provision, but they didn't. I think this Constitutional provision was used to justify the fact that the officers did not give him a sobriety test. Now it seems to me that the officers could have given him the test even with this provision, but I think this was the reason used to justify why they didn't.
