With the options being from worst to best:
1) Get hit by drunk while standing outside behind your car 2) Get hit by drunk while standing outside of car 3) Get hit by drunk while sitting in car 4) Car gets hit while you're outside of car 5) Car doesn't get hit I'd say you're pretty lucky. Sorry about the car, but stick to your guns and make the drunk's insurance company pay for it.

Very fortunate that you weren't injured. I also say stick to your guns. If you want the car repaired, MAKE them repair it: Their client was the idiot, SHE is the one at fault, and YOU are the victim. Don't let her insurance company bully you around. THEY are responsible for repairing your car to your satisfaction. I have had to fight the same battle a couple of times, and I was successful both times. Mike

(sigh...) probably yes it's totalled
I looked at the front picture, and thought, wow, bad luck, that car was MINT, the damage could have been a LOT worse, and then, scrolled down and
Deer (mating) season arrgh. You aren't the only Mercedesshop member's car a deer jumped out in front of the last week. Thank heavens you weren't in the car when it was rear ended. That had to have been a huge hit. From the picture, your car looked gorgeous (before all this), like a new one. Beautiful wheels on it too. And a lovely color, not very common.... It looks "totalled" out to me (sorry to say that). The car was involved technically in two accidents (even if they took place seconds apart.) Unfortunately, the insurance company may therefore claim the damage on the front from the deer accident is "old damage", the cost of which gets subtracted from the market value of the car when it's value is being determined in the Total Loss Valuation.... If it's declared totalled, start looking for "comparable sales" on similar cars, to get an idea of what the car is honestly worth. Many victims of car wrecks like this tend to over value the worth of their cars, but yours is definately at the very upper reaches of value, based on its stunning condition before the accident(s) It might even be possibly worth it to have it appraised independently if the Insurance company lowballs you too much on the car. Hopefully the girl who hit it has her insurance on her car, to pay for this. I wonder if a car hit that badly could be repaired without suffering structural compromise (rewelded replacement quarter panel) anywayDamage looks to me it could exceed $10,000 here, so I think it is totalled. See what happens, if it is a total loss, keep in mind the Insurance company (hers, or your own if you file a claim under your policy and then they pay, and suubrogate and then go after the at fault party) is under ENORMOUS pressure to mitigate damages by settling it very quickly, so you should be able to rent a car, "loss of use" of your car is covered, and dig in your heels if you have to negotiate the car's value, while you go out looking to replace it. Might be a good time to investigate the charms of the e400/400e or e420, which are also fine cars, and VERY quick, and deliver about 80% of what the e500/500e offers, with the legendary reliability, durability, safety and utility the 300e has offered. Just a thought. In any case, our condolences go out to you, this must be tough, when a car you had is that beautiful it has obviously been cherished, while to the insurance adjuster it's just another file on the desk to be dealt with.

Oh my goodness!!!!
I was going to scroll down and quickly write "Not a problem" then I scrolled past the rear pic whoooooah I agree that you can go after her insurance and get it fixed, but I am not sure you would want to if there is some frame damage, and from the price I reckon there is. Ah man that car looked so mint. Is that original paint? Just beautiful. Damn drunk drivers, consider that your car probably saved someones life that day by having this moron crash into it first. |

Sorry to hear about your accident. My 89 300E was rear-ended not too long ago, not by a drunk woman, just by a cell-phone talking moron of a woman. She hit me doing about 60. I was stopped at a red light.
Long story short, quote on repairs was over $5K. Insurance wanted to write the car off due to age. I politely - key being politely - and firmly argued that although the car was old, it was in mint condition and I wanted it repaired. They sent an adjuster to see the car and he agreed with me. They fixed it beautifully and it's been fine ever since. Insurance co. hooked me up with a nice Volvo S60 for the duration of the repair and my rates were completely unaffected. So I'd say fix it if you can. They'll only give you the blue (black?) book value if it is a write-off, so probably worth it to you to fix and keep it - looks like a nice W124. Good luck! EDIT - Only other piece of advice - get it fixed at the best Mercedes shop you can. I had it done at the largest dealership in town. They did a great job. They did have to adjust the frame slightly, and they were the only shop in town that had this bizarre-looking machine designed specifically for working on Mercedes' frames. My car sat hooked up to that thing for a few days, as I understand, in order to align the frame properly. As stated, this was a couple of years ago and my car looks and drives perfectly today.

$10K is probably double what it's worth, totaled for certain. No joy here, I own an equally mint 1993 300E w 112K, and it's not worth snot either.

Kelly Blue Book lists a 1993 3.2 4door sedan excellent condition with 126,000 (slightly above normal) in my zip code as
Retail $6,100 (Trade in: $2,600.) Hate to say it, but she's a goner! If it's pristine, you might get 8-8,500 tops is my guess. Five years ago my daughter totaled my 91 2.6 190E, which had 144,000 on it . Ins paid 7500 less 500 deductable= 7,000. which was right on with the Kelly Blue Book retail value. The insurance co. will obtain a listing of similar vehicle sales in an area around you, judge the condition of your car and make you an offer. Don't forget that all parts estimates are based on OEM, not aftermarket, so, be prepared. |

I think i have good news the body shop adjuster did a close inspection and this is what hi came with.
First Claim: Dear repair cost. Parts 980.00 Body Labor @ 12 hrs 510.00 Paint Labor @ 10 hrs 430.00 Paint Supplies @ 10 hrs 230.00 Total $2100.00 Second Claim: Drunk Woman repair cost. Parts 2200 Body Labor @ 44 hrs 2000.00 Paint Labor @ 19 hrs 850.00 Frame Labor @5 hrs 330.00 Paint Supplies @ 19 hrs 430.00 Total $5950.00 So he told me because this are 2 diferent claims it may work out good but we will se tommorow when the AAA adjuster comes out whatever he says TOTAL is not a option im not signing it. Thats my baby.

I paid $1800 for my Southern Belle 1985 300D. When she got hit the agreement with the insurance company (of the other driver who was responsible) was for me to keep the car and pay me $4400. When your insurance is covering the payout will be low end of market value. (Been there done that) Since your rear end damage was caused by another person you should get a good settlement. I am sure that her insurance company is pretty pissed off. Her insurance rates just became the price of a small home mortgage for the next 5-7 years. If you surrender the car I would not settle for any less than $14000. If you keep the car I would not settle for any less than $11,000.
