Woman faces fines over Christmas Wreath

I think its stupid, those Colorado idiots getting all worked up over a funny looking Christmas Wreath.
It looks a lot like a Mercedes Star to me!

That is stupid and I think the neighbors are being small---but restrictive covenants are a *****--don't like them--don't move to that type of 'hood.

The president of the Homeowner's Association had the architectural control committee review the wreath and they refused to declare it a violation. The President fired all committee members and continued to declare the wreath a violation (according to what I've read)

I'd be curious whether the President has any authority whatsoever to fire other members of the Association's board. If they were elected members, he's probably got no case.

Furthermore, there does not appear to be anything stated in the bylaws of the Association that prohibits a wreath of this type.

Accordingly, it's basically hype for the press. The Association hasn't got a snowball's chance in hell of collecting that fine.

Reminds me of a condo that I owned. A delivery truck drove up onto the grass to the front door to unload a couch for the tenant. I didn't approve of such an action and the tenant had no knowledge of such an action until after it occurred. But, the Association decided to fine me $200. for an action over which I gave no direction and had no control.

So, I paid the fine, under threat of further legal action. Then I took them to small claims court. They never even bothered to show up and present a defense. I recovered the entire amount without any further fight on their part.

She can do the same, and will prevail.

I thought that part of the story was odd also. Committee members are usually volunteers or elected. Made no sense. HOA's are ideal breeding grounds for tinpot dictators honing their skills to take over third world countries.
I used to be a resident manager for a condo association. One of my duties was enforcing the "No ****ing in the hot tub after 10pm" rule.

If the names that the homeowners called me when I enforced that rule are any indication, I was way past the third world stage. I had my own brownshirts and was poised to take over Poland.

I lived in a gated community for several years. It was a trip. Being a wacked-out former hippie back-to-nature guy I began gardening to return my beautiful centepede lawn to a longleaf pine-bluestem savanna which is what the community was before honkies messed wiff it. Lots of things I did I could only do one time before the (poor, harassed) homeowner rep descended on me.

A good friend of mine lives in a gated community. He planted a nice rock garden with clumps of some kind of ornamental grasses, not too overpowering IMHO it was real pretty but the neighbor had a fit over it, her friend was on the committee and all he heard was threats of every kind. He stood firm and the rest of the board all had a look and got together and said it wasn't prohibited in the covenants so he lucked out. Other places have a covenant written by legal types that excluded almost everything you can imagine. Why I bet they hate diesels too. I'm certain they would prohibit making Bio diesel in your garage

The people who move to those places usually had bad experiences in the 'outside' world. A friend of mine had a nice place in the country where he raised goats. His neighbor was nasty as hell though, he built a chicken coop right on the property line, then he bought 2 dobermans that often got loose and came into his yard - not good when you have little kids. There were many other stories, and quite a few battles that solved nothing. Just before my friend moved out, the neighbor bought a rooster that started crowing at 5AM.

He is very happy now in the planned community where he lives.
