Glad you got it fixed and I'd second Howie's advice. How can an agent not notice a sump pump running every few minutes?

It's not really whether you notice it or not its the disclosure you make, you should never make a statement about something you don't know anything about.

In my own experience the Realtor mediator would likely split the fee, but I know we are far from getting all of the info on the issue so there are many other variable but from the info you have given its pretty easy.

However a leak in the water line technically makes the water undrinkable due to contamination which makes the house inhabitable and list goes on.

Take a look at the disclosure, I wouldn't be surprised if they put unknown down.

Did the home inspector notice this? The good ones spend quite a bit of time in the basement, one would think they would have heard the pump...

A good one probably would have caught it, but the leak may have gotten worse recently. These things never get better and will only get worse.

It may not have been leaking a month ago. Or even a week ago.

Tom is once again correct! There was barely any water coming into the pit a month ago so I can't fault the inspector. I'm speaking with my agent about the issue and will post the results.

Back to the absentee landowner thing--they are still responsible--whether they lived there or not. I think Realtor and owner should split cost. Ding your homeowners two or three times for small ticket items and they will drop you like a bad habit.

PS: soil engineer could have told you how long it had been leaking with a couple of borings
