But, I suppose that's a pipe dream.

For reference, the statement is "The average person is a moron"

Assuming they have the intelligence to do so, that is.

So is hoping Jenna Jameson, Briana Banks and Tera Patrick are in bed waiting for me. Not holding my breath. Have to be realistic.

So, if the average person is a moron, do you want one of these average people making up a decision using their "intelligence" or would you rather these people play it safe and follow procedure? I know what I would choose. Yes, I know, reality bites.

It's the Free Speech Defense to the Rescue!

Judge Paul Mahoney says he'll rule in March whether to dismiss the charge.

Justice delayed is . . . American, I guess . . :D

We had an intense discussion on this one. My position is that there was no crime and therefore the charges should be dismissed. Qualifying as a dumbass is a definite possibility.

East Boston District Judge put Simpson on probation for disorderly conduct. If she performs 50 hours of community service, writes an apology letter and stays out of trouble, the charge will be dismissed.

She was charged with disturbing the peace and possession of a hoax device.

What happened to those charges?

Insufficient evidence to prove guilt beyond a reasonable doubt.........and they plead it down? I'm quite sure.

Prosecutors dismissed the hoax charge, which would have carried a maximum penalty of five years behind bars and required proving that Simpson had “the intent to cause anxiety, unrest, fear or personal discomfort,” Wark said.

Wark said prosecutors considered Simpson’s lack of a criminal record, her academic involvement, and the sobering experience of her arrest at gunpoint by members of the Massachusetts State Police responding to what they believed to be a security threat.

Simpson will have to perform the community service with veterans from the U.S. Army in a deal recommended by prosecutors and agreed to by her attorney Ross Schreiber.

Yep, all they had was disturbing the peace. They could never prove intent with regard to the hoax device.

I'm surprised that a good attorney didn't take it to trial. The government had no case.............no surprise there.
