Clarence Thomas

Does Justice Thomas hurt anyone except himself with his personal insults against Anita Hill and the Senators who opposed his confirmation? He is a bitter, angry, arrogant, illogical man who appears to harbor some racial bigotry of his own. What a wonderful combination of character traits for a man who might sit on the Supreme Court for another 30 years or longer.

I was considering one of my Grandfather's quotes but Thomas's words,actions and narrow moral and ethical compass have spoken volumes in the past.

Wasn't he the subject of a Sixty Minutes interview recently? I heard someone talking about it, but didn't see it. He lives not too far from me. No, we're not close, personal friends or anything. I tend to like him just because of the grilling Ted Kennedy gave him during his confirmation hearings. Other than that I know nothing about him.

Based on the autobiography he and his publisher released yesterday, it is clear that Justice Thomas hasn't gotten past it.

I admit that I do find it galling that someone whose carrier path was so strongly affected by racial preferences would write some of the things he has written about affirmative action, but that is not my main complaint about him. I have a much bigger complaint about his twisting of history in his opinion in Bush v. Gore and his bizarre aversion to stare decisis, one of our oldest and most well established legal principles.

Justice Thomas's view that people opposed his nomination because he didn't think the way black people were supposed to think is just another manifestation of his arrogance. People didn't reject his views based on his race. They rejected his views because they didn't like his views. That possibility doesn't seem to have even entered his mind.

Oldest and well esablished princilpes yes. Inviolate? Of course not. If the Constitution is to be a "living, breathing document", shouldn't the Courts decisions be subject to it's own review and revision as circumstances warrant?

I agree with that, but the cynic in me feels that race played a role in some of the opposition.

Absolutely, but that's not what I'm talking about. Based on legal traditions older than this country, courts have given deference, to varying degrees, to cases decided in the past. That does not mean that courts shouldn't overrule cases when appropriate, but they should give some degree of deference to prior decisions. Justice Thomas, according to Justice Scalia, has decided on his own that he need not adhere to that time-honored principle.

I saw him on 60 minutes and an ABC news program. Despite the redeeming quality of liking his Detroit 8V92 diesel in his motorhome, I thought the interview basically reinforced the opinions of his critics. I wonder what the other Supreme Court justices think of his book promotion. Have other Supreme Court justices written autobiographies and promoted their book while on the bench?

He talked about his leaving Catholicism and then returning to it. I didn't hear him express any deep thoughts about legal philosophy, just references to his grandfather's hard work. Made me wonder whether he had any deep thoughts about the law.
