It appears to be quite obvious to me:

Smells like iran contra... Mexico gets their gang banger, we get out Blackwater body guards, Al-quadea (of Iraq) get's their 'failed' border jumper.

This could a set a precedent where foreign law takes precedence over US law. It shouldn't fly because laws are made to be a foundation for the people (votes are the ultimate power, ha, ha) and treaties are written on the fly between nations. One who has the authority to agree to a treaty would be given supreme power over all laws. At that point The Declaration of Independence says that we must have another revolution. Then things get really messy.

Sorry man, this is a nasty story. Don't need to drag TK into it. I mean I don't like the guy but . . . .

Turn it inside out: Let's say an American citizen is accused of a crime in a foreign country. Would we prefer that the American have access to the US Consulate before trial? I would.

In order for international law to work there must be willing participation of signatory countries or a real and credible enforcement mechanism. Since the latter requires the willingness to employ an act of war, usually the former is a less dreadful path.

Twitchkitty makes a fair point, too. But carried to all international treaties, it becomes a disorganized mess in which each state of the United States decides whether or not to follow the national will through treaties signed by the president and passed by the senate.

I have to side with Bush on this one also. One only hopes the end result is not some slime, guilty of gang-raping and killing two 14 year olds (if indeed he is guilty), smirking his way back to freedom in Mexico.
