Man gets 10 years for fatally shooting tire thief

A Baltimore man who interrupted and killed a thief trying to steal tires off his Mercedes sedan was sentenced this morning to 10 years in prison for involuntary manslaughter, with half of it suspended.

Circuit Court Judge Kaye A. Allison also sentenced Charles E. Brockington, Jr., to a concurrent five-year sentence without parole for a handgun violation. Brockington, 48, is a convicted felon and is prohibited from carrying a gun.

Assistant State's Attorney Mark P. Cohen said that Brockington heard noises outside his home as he was getting ready for work around dawn on June 29 in Northwest Baltimore's East Arlington neighborhood. He came outside wearing only his underwear and holding a semi-automatic handgun, Cohen said.

Brockington confronted Joseph Milton Johnson Jr., 29, who had raised the 2006 Mercedes up on cinder blocks, and ordered him at gunpoint to return the tires. Johnson agreed, but as he went to retrieve three of them from his 2000 Chrysler Concord, he tried to distract Brockington and make a run for it, according to court records.

Brockington then shot Johnson once, killing him. The victim's relatives told police that Brockington had purchased the tires from Johnson, of Gwynn Oak in Baltimore County, but still owed him money, which sparked the confrontation. Cohen, however, said investigators found a store receipt for the purchase of the tires, which showed that Brockington had paid about $1,500 for them.

I see two problems

1. Brockington, 48, is a convicted felon and is prohibited from carrying a gun

2. He obviously didn't know about Tire Rack here on the forum.

Man thats a tragedy locking a guy up that can hit a moving target.....and kill them.... in the dark... is a waste of talent, they should have at least given him an Army option.

While I agree with the whole convicted-felon-shouldn't-have-had-it-in-the-first-place thing, can't we get him a shorter sentence? I guess that's just the way it goes, do a good deed and this is the reward you get...

Does the army recruit felons? Hope not.

I think I got lost in NW Balto. a few years ago, looking for Pimlico with a couple of (biker) friends.
When I saw a guy on the street wearing an overcoat in 90+ degree heat in the middle of August, I knew we were in a place where whitey don't want to be after dark.

The thief probably wanted money for drugs, ya think?

To paraphrase Abe, the world will little note nor long mourn the loss of Joseph Milton Johnson, Jr., tire thief, late of Baltimore MD.

And another one bites the dust.

That said, the shooter got off easy, imo. Would'a been worse here in NJ.

I think this is where the problem lies. He got his wheels back (as I don't think the perp removed the tires and left the bare rims behind ), what was the point of shooting a running man who didn't pose any danger? He left his car behind, the cops would have picked him up in a flash anyway. Whatever damage, if any, he may have caused to the Benz would have been covered by insurance. So yes, some jail time is warranted.

That would have possibly warranted a perjury charge.

Hey...what're trying to say? My incident was at 4 am...not "around dawn!" I did hit my target though...I wasn't planning "one shot, one kill." My intention was let these guys get some jailtime when someone finds a "well marked" car.

The convicted felon part sounds like the only thing that did him in...and the fact that it sounds like he shot the guy in the back. That's why my rounds were aimed at the getaway car, not the guy on foot left behind by the getaway driver.
