Moped rider defying death

Today I spotted one of those little scooter things which folks who have had too many DUIs drive. The fellow riding it was scooting along in heavy traffic with no goggles, no helmet and talking on his cell and driving the scooter with one hand!

I find that strange, since they give DUIs to bicyclists regularly.

A bicycle is a vehicle in most states. A moped with an engine under 50cc isn't technically a vehicle.

I've got a couple of them. No license or registration required in Colorado.
I'm curious as to whether law enforcement has ever actually disassembled a moped engine and measured its displacement. There's a lot riding on that one cc. Many people bore them out for additional power.

You need a driver's license to operate them on public roads around here. Nevertheless I see some preteens riding them around the neighborhood.

I didn't know that. Now I'm worried that when I'm climbing a steep hill on my bicycle, get tired and begin to weave a little bit, the cops are going to think I'm drunk.
