USSC gives detainees habeas rights

In a stunning blow to the Bush Administration in its war-on-terrorism policies, the Supreme Court ruled Thursday that foreign nationals held at Guantanamo Bay have a right to pursue habeas challenges to their detention. The Court, dividing 5-4, ruled that Congress had not validly taken away habeas rights. If Congress wishes to suspend habeas, it must do so only as the Constitution allows — when the country faces rebellion or invasion.

JD, what does it mean in practical terms that us legal laymen can understand? And what is the cost you refer to going to consist of?

I am thinking maybe it will simply result in the release of most of them.

Without a doubt, it increases the likelyhood of more attacks on America.

Lesson learned,,,, Next time, take no prisoners. Torture 'em for information and then stab 'em to death with a sharpened pig rib, right there on the battlefield.

I hope the ACLU is happy. The terrorists certainly are.

I don't know about the ACLU, but I'm happy strict constructionist judges decided to be strict constructionists in their deliberation.

As for stabbing them on the battlefield, I wonder how many were on one.

Wow talk about a victory for our enimies! If I was in charge I would be very quickly getting these SOB's to Isreal where they know how to treat terrorists.

As the ACLU nut jobs try to represent them, sorry Isreal has them, good luck.

It means they are going to get trials in court at the expensive of the American tax payer.

Thats like ruling the Nazi's we caught at the end of WW2 should have all gotten trials in US courts since the Constitution applied to them. This situation is even worse because of who we are dealing with.

I believe the Nazis did get trials did they not? Granted it was a tribunal but it was out in the open and I believe the law was followed.

They get a trial. If they are guilty, they will be found guilty. If they never did anything wrong, they will be found innocent and sent home. It's sort of a big institution in American civilization.

If you are against it, then why do we even bother fighting them?

Military tribunal systems cost American tax payers more money.

We will pay for the trials either way.
If they are done by a military tribunal, or by the current judicial system.
We pay for both.
The military is funded by American tax dollars also.

Seeing that we already have a judicial system and prisons in place.
It costs the American tax payer more money to have these
redundant military tribunal systems set up for these cases.

Do you remember the videos of American contractors in Iraq getting
there heads severed from their bodies ???

If we do what you are suggesting "take no prisoners, torture ' em, and
stab them to death".
We become the hooded people in those videos that are wielding the knives !!

And that would increase the likelihood of another attack
upon the US as a retaliation.
Just like we retaliated against them.
