Good for them. Those kind of laws are an essential element of defending 2nd Amendment rights. More places should enact that type of legislation.

I'm trying to find out which states have the No Retreat law. So far I have Fla, Tex, Arizona and Kentucky that leaves 10 more...

The actual shooting took place on HIS front lawn.....so in essence is was his property. However but, the initial burglary took place on his neighbors property. I love Texas.

It sounds like the law is to defend your life, not your property. I don't think he would be protected if he shot them while they were driving away.

Just an observation. From the news story description, I think the element that's most important is that the stolen SUV was heading TOWARDS the shooter and that the shooter had a reasonable fear for his safety and life. No matter where you are, your property or elsewhere, the legal defense for the use of "deadly force" is where you believe that your life or the life of another is in imminent danger.

in the seocnd case sited(sp) in Wikipedia, since the neighbor called 911 and told the operator he had his rifle in his hand could there have been a possibility this could turn into premeditated manslaughter?

Similar case this week in SC. Guy in a house looks out window and sees someone with gloves climbing his chain link fence in broad daylight. Guy in house gets gun and goes outside. Perp on fence flees to waiting getaway car and homeowner fires at them. In panic, getaway car gets stuck in ditch in front of home. (I don't know if the spot was on homeowners property or not. Will try to find out.) Homeowner continues shooting and hits perp in chest, critically wounding him. Getaway car driver escapes on foot and is not yet found. No weapon found on wounded perp or in car.

I need to find out exactly what our state law is. My expectation is this homeowner crossed the line. I don't think the homeowner could reasonably claim he thought his life was in danger when the perps were fleeing. Protecting your life gives you a license to kill. Protecting your property does not.

I think one can claim so. I see it like this. If someone comes onto your property trying to kill, rob or otherwise harm you or your family, don't let them leave your property alive. Cause the fleeing perps can always try to come back to finish you or your family off if the opportunity exists.
