Sometimes Neighbors really annoy me

While on a special vacation there was a huge storm here in IL.
Did major damage to several of my trees.

But a HUGE willow from the neighbors yard landed in mine.
I let her know Wednesday morning, then went by after lunch today to find out whats going on.
"It's not my tree".
First your husband told me years ago these tree's were on your property, not mine. AND when one of the neighbors did something the surveyors found the property markers further putting the tree in YOUR yard.
OK, why didn't you have the courtesy to come and tell me you wern't going to do anything.
It's not my tree.
So I spent the afternoon locating the markers and then proved to her.
She basically got beligerent with me and said "When" she feels like checking on it, and "When" she feels like calling she'll get it taken care of.

Again this is (WAS) a HUGE willow, 40 feet tall, two people arms linked around.
So I have this laying in my yard, destroying my lawn (OK I'm a bit anal about my lawn, versus her weed invested 2 blades of grass per acre greenery).

OK she's very elderly, but I tried to be very polite.
Today I also was polite, a bit sharp the second time. BUT POLITE.

She basically told me to stick it, not in words, but in response.

She had major damage to a tree over the winter, they just cleaned it up when they took care of some other storm damage.
Her husband used to mow his lawn in thirds, not the front third the middle third etc. Each week he did every third row ????


For years after we moved in we were friends, the 4 neighbor (men) used to sit in the corner of the yards (under that willow) and get bagged. Sometimes pretty well too.

Tuesday I will try to contact her son, he's out of state and the number I have may be old.
If I don't get a response from her, or him, I will probably file a police report.

I'd rather not but I fear it's that or it will be 6 months.
At least with a Police report I can eventually take care of it and bill her (small claims probably).

OK just ranting.

I have another neighbor strange as can be. Nice guy but strange.
And another whose yard for years looked like a dump, they have actually cleaned it up fairly well lately, I may have to clean up my junk corner by them (rot pile, excess firewood etc.)

And then other neighbors I would do whatever I could to help them.

Depending on state laws, the part of the tree in your yard might be your responsibility. It is thus here in PA. I just spent $2000 to have 3 blown down trees removed from my yard that were growing in the neighbor's yard. If the trees had fallen on a building on my property, my homeowners insurance would pay for the damage.

Oh, c'mon, if you're that worried about it, you can probably take care of it over the weekend. Sure, it'd be a lot of work...but, it's probably the quickest way to make it happen with the least $$ out of your pocket.

Wanna borrow my Stihl?

C'mon that's a neighbourhood party waiting to happen. Bust out a chainsaw, hack it up, round up some local teens and pay them $40 each to haul the wood into a pile and then you can burn it during the winter and enjoy some ambiance if not some heat savings. Share a case of Bud afterwards. Tell the old crotchety lady she's on the hook for the beer and teen wages, or split it.

But I hear you...some people can apparently be annoying just for the sake of it. With many neighbour disputes, I've found it's usually a misunderstanding or a lack of proper communication that leads to the issue and it can often be resolved with some diplomacy.

Ranting on a forum beforehand can definitely help with the latter aspect though.

P.S. Makes me feel better about my recent-ish move from an urban lot to a 2-acre lot just on the city edge. Neighbours aren't an issue anymore, don't miss that part.

I can't believe if you drop crap in my yard it's my problem.

ComEd asked years ago if they could take the tree down, I told them I'd love it, but it's not mine.
She claims she called CommEd to find out who's tree it is, I looked at her and asked what do they have to do with it. She said they'd get back to her.

If it was maple, oak or ... I would consider it, but I have no way to dispose of that amount of willow. You can't burn it, if you can get it burning it makes a stink bomb smell like flowers in spring.

Even though I can clear trees as good as anybody, that is a HUGE TREE.
That stump is 48" across, not diamitor, across !!

Some of those branches would make my 18" chainsaw work more than it should.

And I have enough clean up of my own trees. I already spent 8 hours (4 with the wife helping) just to cleanup the stuff on the ground.
Probably have almost that much more taking down another tree, and cleaning the damage out of another.
Although they are maples so I now have almost enough firewood to cover NEXT year, this winter is easily covered. And we normally buy 3 face cords plus another 1 or 2 we produce via tree trimming/damage.

PS I mentioned she had damage to her tree over the winter, the wife corrected me, it was LAST winter. So it took 18 months before she cleaned up a bunch of downed garbage in her yard. The landscapers just mowed around it. If this hadn't happened it would have been there another 10 years.

Play hardball, nice guys finish last. If its her responsibilty find out the proper course of action to notify her to remove it, you probably have to send her certified letters or something. If that doesn't work than pay to have it removed and go after her for the bill, if she refuses to pay take her to small claims or lien her house.

Not sure how it works in your state. Around here the city would come out, clean it up and send the bill to the owner.

Looks like free firewood! I'd be out there hacking it up and putting it in my wood pile.

A move you would regret immediately after putting the first piece in your stove. Willow is about as useful as cottonwood for firewood, and smells just about as nice "if" you can actually get it to burn (picture Boy Scouts breaking camp)

Nice yard BTW....'cept for that frickin' tree...
If it were me, I would limb the bastid, and heave all the pieces into her yard, then at least it would only be the trunk killing my well tended lawn. If you were closer, I would bring you my skidsteer, and you could eventually push it all back over the line.

In general I hate neighbors.
My style is to try and be nice, AT FIRST, then I don't bother with hardball.
It goes straight to nuclear warfar.
I already have a quote to remove it, he might even give me an "extra" invoice.
And an attorney friend to handle it or at least help me with the small claims stuff.

BUT she is elderly, pretty much living her on her own, One son on the east coast another I've never met in Southern IL last I heard.
She's not poor either.
But I will try to be nice AT FIRST.

Hmm, gotcha. That is unfortunate. I don't have any experience with willow, we don't have a lot of it here.

LEGAL ACTION

So Willow is nasty to burn and thus renders it useless as firewood. If you cook with it, the food is gross as well.

In the spirit of turning a lemon into lemonade, simply cutting down a 48" diameter tree with an 18" chainsaw and getting a giant pile of firewood is not going to work since said firewood is bad firewood.

She is an old lady, she can't possibly move it. She does however, have cash and a telephone as well as a phone book or Craigslist. She has the power to take care of her mess if she needs to.

Given her track record, she is not going to take care of it. She is lazy, rude, and old. Not the good golden old, but the tarnished rotted old. The kind that is pissed off at the world and pretty much ready to leave. At least that is what I am getting from what has been said so far.

Now taking legal action will probably destroy any remaining relationship with bitter woman and her husband. It is your lawn and their crap. Their crap is on your lawn. If you want it gone within the week, you know what you have to do.

Here's an idea. Instead of whining about it on some forum, turn the computer and all other electrical toys off and go next door and politely tell her you are going to cut the tree up and stack it on her property to dispose of as she wants. If you have a lawn tractor drag the pieces over there, it's not far. I've cut far more dangerous trees(tree service calls them widow makers) from my neighbors yard that fell into mine with no more drama then the neighbors saying thank you. Heck, they even brought me home made chilli and soups and there is no hard feelings on my part. Just the price I pay for living where I live. You might want to look into a condo if that little tree has you upset.

Agreed. Instead of acting like a douchebag lawyer, be a decent neighbor and help the little old lady out.
