Need advice...
I might have a seller who screwed me over on Gunbroker.com over a set of sights for my Sig rifle. I sent him a check from my bank three weeks ago this Friday and still have not received my sights.
Granted it was only $265 but I am pissed!:mad: Tomorrow I will send him a final message saying that if the sights or a check is not in my hand by Wednesday I will push this up to the next level.(three weeks plus a few days from when I sent the money) But I am pissed I am ready to report him to the postmaster general, but I am wondering about my legal options. I am meeting with one of my attorney's tomorrow about and unrelated thing, and will ask him. My question is can I sue him in CT through small claims and screw him over pretty good? At this point I am pissed and would gladly spend a few bucks to make this POS sweat.:mad: Even though it will be a waste of money spending a few bucks will be worth it. I think at the very least my attorney will be sending him a letter.:mad: |
Good reason to use paypal.. it is stupidly easy to get your money back with paypal.
Has he been communicative at all or has he ignored you? |
Small claims is useless, for the most part. You're looking at a loss of less than $300, which you'll never see through the courts. This loser doesn't sound like he'll show, which will give you a win by default...but what good will it do? I think you're spinning your wheels thinking of this venue.
Filing a complaint with the postmaster general sounds more plausible. Good luck |
Yeah I am kicking myself for not using paypal, I would be at the bank tomorrow doing a charge back on the card.
He has been very talkative, today after I got a little unfriendly he sent me a USPS tracking number which doesn't work online. Tomorrow I will go into the post office and see what they can make of it. As far as I'm concerned two possible things are happening: 1. They are shipped and taking forever. 2. He is screwing me out of $265. Either way I am done being nice and moving onto prick. I gave him just about three weeks of nice guy, that's over. I have already reported him as a non shipping bidder on gunbroker. Supposedly they take this pretty seriously, I will try to get his account suspended. Just for grins if my attorney has time and isn't charging me $300 an hour I may call him in his office and see if I can scare him. If he is the little POS I think he is a call from a lawyer might scare the crap out of him, either way it will be satisfying. |
Hm. If he is still talking to you I think he's just a slowpoke basterd.
USPS tracking numbers are kind of useless (especially compared to UPS) because sometimes they take so long to update and show you information, that by the time you see any updates, you already get the fricken item in the mail 3 days later! But if he JUST shipped it out today, it will take at least a day for it to show any updated information, if not 2 days. So i'd wait a couple days before doing anything drastic. And definitely ding him on feedback. He probably didn't have it on-hand or something and had to order it or was just lazy. |
I presume he's already cashed the check so you can't stop processing.
I'd say do some research on the gun retail sites and see if he's got a track record for any trend. Is he a frequent seller? A first-timer? Does he have a history of delivering, but just slow? Keep a log of calls, e-mails, etc. Don't make threats, especially in a transaction about weapons. |
Well I'm feeling better about it today. I didn't have time to stop by the post office and the tracking number still doesn't work. I could check with my bank on the check but I'm sure he has already cashed it.
But he is responsive, and has a 111 perfect feedback score, so he has been around awhile. Gunbroker.com also insures all transactions, so worst case they will reimburse me and boot the seller. Gunbroker.com is like Ebay except their policy of booting scammers is serious and has teeth. When you deal with the kind of stuff they list you can't mess around. Today since I still have not received the sights I reported him to gunbroker as a seller who failed to ship. Which as far as I know at this point is the case. The first step is they put him on notice. Since I have all my paperwork the next step which has to happen between 30-60 days after winning is filling a claim, than I believe his account is deleted and he is booted. September 6th is 30 days so I will wait until Friday the 10th to start this process. I don't want to wait to long, not sure how long it takes. This is the end of week two from when the sights were supposedly shipped, so three weeks and if they don't show I'm going to assume they were not shipped. |
More to the story, first USPS tracking number started to work...delivery was for today! Except it was for something in CA.:rolleyes:
Now I have another number, which again starts to work. By Monday if this number doesn't start to work and look like its coming to me I'm taking it to the next level. |
"Only" 265??? wow.......chump change to some I guess. Get a refund from gunbroker and fo'getta bout it.
