Advice needed: Got a parking citation in the mail today after I sold the car
about 2 months ago.
Car was sold on 10-15-10 and ticket was issued on 11-5-10. I received the $55 ticket in the mail today. I mailed the transfer of liability (from original pink slip) to DMV the following day of sale. Is it possible that it has not been processed yet? I didn't make a photocopy and now wish I did! Do I pay, which I absolutely do not want to do foor someone else's irresponsibility, or leave it alone. Payment is due 12/14. I will have to call the Los Angeles Parking Violation office and see what I can do, but in the meantime, what should I do? |

Get a hold of someone at the DMV and see what your options are. I see for no reason why you would have to pay that since it is the DMV sitting on its hands.

I wouldn't pay it tell them to go after the new owner.
Did the new owner register it? Why is it still in your name? Did you sign over the bill of sale?

I don't know why California DMV still has the car under my name. I detached the NOTICE OF TRANSFER AND RELEASE OF LIABILITY from the pink slip and mailed it to DMV the next day, which would be 10-16-10.
I have a copy of the bill of sale that I typed out but not a copy of the actual NOTICE OF TRANSFER AND RELEASE OF LIABILITY. If the $55 isn't paid by 12/14, then fee jumps up to $110. What happenes if I don't pay it? I do plan to contact the LA Parking office and the DMV, but I doubt things can be resolved before the 12/14 deadline. I'm guessing and hoping that DMV hasn't gotten around to processing the Transfer notice I sent them. In hindsight, I should have jotted down the buyer's driver's license # and address as stated on his license. What if I have to pay for his irresponsibility and inconsideration? |

and yet another reason why 'plate-to-owner' is superior to 'plate-to-vehicle'. can you go to "city hall" and find out if this happens semi-frequently? perhaps there is an appeals process...still is a drag on your time

I had a SOL (sister-out-law) that bought a car from me...I made her pay cash, but in the process, she wanted me to let her keep the plates on the car, since they still had a few good months left on them and she was willing to pay me for the unused months left.
I told her, point blank, "NO." She pleaded, but I didn't relent. And I made sure she signed the "receipt" that I made out, attesting to the fact that I don't own the vehicle and she is now in possession, title and all. We actually stated the correct amount ($500.00) so there would be any discrepancies should "something" become amiss. Sure enough, about 4 months later, I go down to the DMV and there's two parking tickets preventing me from renewing my van's registration. I check the date and the "violation information" and it's her car. There weren't plates on it, just a cardboard "LAF" - so the officer made out the tickets based on the VIN. I had to go home and dig up the paperwork on the sale and bring it back. Fortunately, the DMV office for the La Crosse area was able to clear the title off my name and I didn't have to go down to, or screw around with, the Madison DMV fortress and try to dig my way free from that bureaucracy manure pile. Any transfer of ANYTHING that has the stink of governmental entities on it REQUIRES paperwork, and more you have stating you're right and they have you mistaken for someone/something/whatever else, the better. But it's up to you to do it on your own, and do it so that the latest/newest newbie "government hire" can understand what you did...and still, there will be some supervisor that still won't understand anything you're talking about. And the only joy you can get out that is the fact that that particular moron is standing right in front of you and you know, deep down in your guts and heart, you're keeping a carload of kids safe from this idiot, because you know someone is going to be killed by this nimrod in front of you if you let them loose too soon. ( I, obviously, managed to avoid prison time that day 'cause I kept telling myself, "Self, be happy you're doing your part, RIGHT NOW, in keeping this moron off the streets and completely clueless behind this counter." GOD will provide you with a good home..." ) I feeling much better now...

Show the signed bill of sale and title in court and should be all set. As long as you made copies

Call your DMV and get them to send you documentation showing when you sold the car. Then send that to the court. Then they will dismiss the ticket. Here in Washington they used to have a system where they only updated the owner when they received the report from the buyer. They also received a report from the seller, which they only recorded, but did not transfer the owner based on it. Now they transfer based on either. I had the same issue.

one other thing to be aware of.back in april of this year i sold a bmw to a guy from another state.and for some dumb reason i was talking to my insurance agent about it and the fact that i wanted to drop the coverage on it.they said that until the car was transfered that i was still liable for it even though i no longer owned it.so i kept coverage on it and a week later called his local dmv to see if he had in fact transfered it,and he had so i then pulled my insurance.

We have a system with two separate registrations, one for the car (part 1) and one for the owner (part 2). All relatively large, they do not fit in a wallet and have to be carried all the time when your driving.
If you buy or sell a car you have to go to a post office, they have a connection to the DMV and print a new owner registration. The previous owner gets an document that frees him from all responsibility for the car. Rob |

Just went through something similar to this with the California DMV.
Got a letter sent to my AZ. address stating that due to expired registration on my car i would be charged X amount of dollars, future registrations would be denied, my children would be re-possessed, etc., etc. I got a laugh from it considering the fact the car was abandoned in AZ in 1992 and I applied for an abandoned vehicle title for it in 1994. 'course the fact they sent me the letter to an AZ address SHOULD have been a clue I didn't live in the state of California. Had to give Ca. DMV a call and,as far as I know, it is cleared up. The officer I talked to said he is spending most of his day fielding this type of call. |

A bill of sale, which I have a copy, is not valid proof for the LA Parking office. I'm going to call DMV and then the Parking office to see what's up. I sold the car with tags that won't expire until 5/11. I did everything on my part. I'm just a bit ticked that the new owner hasn't even registered the car.
So should I pay now and then wait to clear my good name and get a refund or Don't pay one penny? By the way, this was my beloved Benz. |

I believe this is known as an open title situation. when selling a car, it is best to physically walk into dmv or a licensing center and transfer the car's title to the new owner. THEN, give him/her the keys. no muss, no fuss.

I sold a car to a guy and he never came back for title and the next year I received a tax notice for the car, I didn't pay the tax and junked the title. The very next day, The guy showed up for the title and I said tuff $hit.
