The Mercedes "New Car Smell" Defense.

No surprise I guess. It's always the third party that's responsible.

According to Erzinger’s defense lawyers, Erzinger suffers from sleep apnea, and that condition was exacerbated by the new car smell of his month-old Mercedes. And that all caused him to lose consciousness during the hit-and-run fiasco.

It happened in the summer? Think the A/C was on, allowing fresh air into the passenger compartment, diluting the concentration of the vapors?

Ummm, don't the new MBs have that drowsiness sensor that beeps if you fall asleep?
I think I smell BS!

I can see new laws saying that cars cannot smell like cars anymore...

And if we made new cars that smelled like "kitty", guys would probably be awake all the time.

"Due to the "kitty" smell, my client's libido was raised to such an extreme level that he became distracted and did not see the gentleman riding his bicycle. Had the vehicle been free of said odor, this accident would not have happened."

Or there would be a spike in business at Long John Silver's.
