Selling car parts

Big brake kit bought from Ted Harbit at a Stude meet. Fits ’51 through ’54+ or–, incl. drums, cylinders, bearings, hubs, seals and shoes. Please make offer. Tom Walgamuth at......

This is an ad that I ran in the Studebaker driving club classified. A nice man from canada called and said he wanted them. He did not want to pay shipping to canada so I took the parts to my sister's house in South Bend, a two hour drive one way from here and left them there for him to pick up when he came for the big spring studie swap meet.

Today i got an email from him saying they are not 11" drums, are not finned and are not from a 64 hawk. NOne of the above features were offered from 51 to 54.

He paid me $200 for the kit which I originally paid 250 for. Now he wants his money back.

I do not feel inclined to give any of the money back to him. He is offering to deliver them back to my sisters house next time he is in South Bend.

I am inclined to tell him he needs to sell them.

You can always tell him "no." Not like a Canadian will sue you in a US court over $200.

Have you asked him which part of your advertisement mentioned 1964, 11", finned and Hawk? From what I read of your ad in Post #1, he misread the ad and so you would be protected by caveat emptor. You disclosed properly, he jumped to a false conclusion.

You may, of course, choose to be a 'nice guy' and refund his money and accept whatever good karma comes your way from this act of kindness.

He needs to resell them. Something is odd. Things might go awry if you agree to accept them back.

Its wierd. The guy has four or five studies so he should know inside and out what brakes came what years.

I think maybe somebody at the swap meet said "oh you don't want those old 10" drums you want the 11" finned ones".

Or maybe he is trying to scam me for the parts free knowing I don't want them back....and he knows where my sister lives.

I think I'll tell him if he returns them to my house I will refund half his money, keeping the rest for my bother to take them to south bend and all.

Maybe he will go away.

So this evening he sends me a string of emails in which I tell him it is an 11" drum. I remember going out to check the size of the drum and am wondering how I could have measured it at 10" and then send him an email that it is 11".

It looks to me like a person can forward an email from someone else and change a word like that and not be able to detect it. My $%&#@&! comcast email arbitrarily prevents me from seeing my original sent email to him and I cannot see how to get to it (it must be here).

For all you know, the parts this gent plans to drop off aren't your original brake kit, but pieces of junk out of a scrap yard - having already made good use of your brake kit, or sold it at a profit to someone else.

Sounds to me like this guy is a scam artist, and you're probably not the only one he's attempting to take advantage of in this situation.

i would agree with this.just where in your ad did he see they were for a 64 hawk.jeez man.if it was a benz would they fit that many yrs apart?i know on my old chevelle there were about 8 yrs they were the same but man 12-14 come on.i'd say hey the ad said 51-54 they are your babies.i had a guy years ago that bought some big block chevy blocks from me.he came down from wisconsin and they were just bare blocks.i told him there and then i will not guarantee they are cracked or need bored.and he was fine with that.then about a month later he shows up out of the blue and wants his money back as 2 of the 4 blocks were cracked.and when he dropped the tailgate of his truck i could tell they weren't mine as they were actually pretty clean but still had paint on em.mine were rusty hulks.i told him tough chit.you bought as is where is.he drove off pissed but hey.thats life.

Exactly. To me, that sounds like what's happening in this case as well.

Few years back, my mother tried to sell her '92 Mustang convertible on autotrader. All we ever had come by were the tire kickers and used car dealer reps, trying to lowball her so they could sell it at a markup retail.

But one guy really took the cake.

I'd went over the car and made sure everything was in good working order, including the exhaust - a little rusty on the outside because of age, but still intact from engine to tailpipe.

This gent took it for a test drive and asked permission to have the local garage he dealt with check it out.

When he came back about an hour later, he immediately started raising hell about how we were trying to scam him, and one of the items he pointed out as being "wrong" with the car was that "the exhaust system is shot and there are two big holes rusted out in the pipes".

I looked underneath the car - that turkey had went and knocked out two big chunks out of each exhaust pipe between the cats and the mufflers. Later examination up close, it looked like he'd taken a hammer and chisel to them.

Of course, he said as is the car wasn't worth what we were asking, but made a lowball offer about 1/4 of what we were asking to "take it off our hands so your mother doesn't have to go to the expense of fixing it up".

I was so damned mad I felt like I had icewater in my veins - that cold quiet type of anger where you're so pissed off you feel like actually doing physical harm to someone.

I managed to calmly tell this SOB he had two choices - one, he could immediately leave our property and never come back, or - two, I could forthwith call the police and file charges against him for vandalizing my mother's car.

Young man rather wisely chose option one.

And to be honest, I was entertaining a third option in the back of my mind that went unspoken - going inside and getting my shotgun and "remodeling" his vehicle in the same manner he'd done to ours, if he wasn't long gone by the time I came back out the door. That that thought had even crossed my mind, should speak to the level of pissed this jerk had managed to push me to.

After that experience, we gave up on selling the car, just repaired it and kept it around as a spare vehicle.

There were no 11" brakes offered from 51 thru 54. this guy has 4 studies so he should know that.

Tom,
Did you maybe accidentally pick up your "11" scale on your way out to measure them?

Be a hard liner on this one--the guy sounds like he's the one with the issues.
