Bullying in American high schools has gone on for generations and never given much currency.

Good that it is being done so now.

That said, I think that California, especially Northern California, and specifically San Francisco and Berkeley, in the bay area, are over the top here.

The LGBT community, is now, currently trying to pass a law allowing transgender high school students to personally pick and choose WHICH gender bathroom they would like to use, in the high schools, without regard to any disruption to other male of females.

I can't see the validity of this, ie, their wishes trumping everyone else's.

Isn't a better alternative to use a teacher's or staff bathroom maybe?

This would allow the teachers, presumably more mature and tolerant, a chance to deal with the issue equably, at least more so than high school students. And teachers aren't known for "bullying" their students, if for no other reasons the consequences for getting caught doing it would likely be dire to their professional career tenure or advancement., I'd think.

I'm guessing that numerically that transgender students are far outweighed by students of both genders NOT of that proclivity.

I think everyone has the right to use the bathroom in peace and dignity, but that said, this lo seems to me like "Political Correctness" run utterly amok.

Somehow I think this kind of thing would not gain much traction in OTHER areas of the Golden State. .

Though of course. bullying is a bad thing, and I hate that it exists in any form. the worst of it in high schools by teenagers has been known and documented to drive the victims to despair, violence or even suicide..

The DA has to follow the law. Some people are not more equal than others. In the court it should be shown that one person was being bullied and whomever threw the first physical fist- they should be the one convicted- if that is the law. Unless there were "fighting words" proven. That's my take on the legal aspect. The personal aspect is that IMHO, tell the bully that if you continue you will find your teeth need dental attention the next time you bully me. Then if they bully again which is physical, re-arrange part of their face.

The DA is charged with following the law, but has plenty of discretion as to which cases he feels are worth prosecuting, and various factors, such as likelihood to obtain a jury conviction, public policy considerations, time and Departmental budgetary expense, admissibility of evidence, witness credibility, caseload, public opinion and other factors come into play.

As to the personal aspect, well ....bullying like that often occurs in cases where there are many bullies at the same time, and the victim is always alone, to get isolated/picked off, and can't fight off several, or more than one, at once with bare fists. No escape. Yah sure, he could dream about hosing down the lot of them with an AK-47 but that can't happen in the real world without consequences that would dog the vic forever.

Maybe not even in a George Zimmerman type of situation...

People don't bully others which are like themselves and if "diversity" is so good for us as a society, and taught that it's good and needed on a nearly 100% basis in all USA schools, why is there bullying at all?

Does s/he have the right to a jury trial? Hopefully the jury will do the right thing and let Gutierrez walk. Jury nullification is a G-d given right and a DUTY, and should be exercised as needed.

Yes...

Often as not, insecure female and male TEENAGERS, who oftentimes are pretty much otherwise ok citizens.

Easier to get away with it when it's a mob or when no witnesses to it are around or for many reasons would rather ignore it or avoid it.

Not only teenagers. I'm sure that many fine, upstanding citizens, pillars of their churches, also happened to be members of the local Klavern.

Bullying is a natural behavior in every species of mammal that I have ever heard of. Watch a litter of puppies. Cute, huh?

To not bully goes against nature. We wouldn't want people burdened with having to act against their natural impulses, would we?

This business of bathroom use gives me a headache. The whole transgender thing does. Grass is greener on the other side run amok.

Since, as you say, the numbers of transgender students will virtually always be very small, one bathroom on campus for their use ought to do.

That said, the video makes it look like more than the TG individual were engaging in violence. He/she almost certainly didn't start it.

Actually arresting someone for a school fight seems strange. There was one big kid in 8th grade who kept poking me, pinching me, making fun of me, generally harassing me, but not resorting to fists. One day, as we were leaving class, he whispered something, and I turned around, kicked him in the gut right under the ribs. Left him there gasping like a fish out of water and crying, probably lucky in retrospect that he didn't have to go to the hospital.

No cops were called, but I was suspended from school for a few days. The weenie never spoke to me or so much as looked at me again -- message got across.

This wasn't a fight perhaps? As was indicated, he made it physical. In your example, there was already a physical relationship.
