I saw that in the news... so much for "Peace in Our Time"

Here's an ironic story:

My nephew got a summons last summer for accidentally swatting away ...and killing in the process... a baby seagull that was dive-bombing his young daughter's hot dog while they were seated at an outdoor restaurant table near the beach.
So, after getting heaped with verbal abuse from the "birders" () in front of his kids, the owner calls the local US F&WL agent. Seagulls are a Federally protected species, don'tcha know. He gets a summons to appear in court which will be in Feb. He hired a lawyer to defend him as he is worried about any conviction in his line of work. I happen to know the municipal judge & maybe I'll go as a character witness when he has to appear. His fine can be from $300 to a $2,000, if you can believe it.

Seagulls are nuthin but flying trash cans, imo, as one who has been "bombed" by them more times than I can remember.


I sent him an email this morning with a link to an article about it and gave him this suggestion.
"Make sure you tell the judge seagulls are not friendly. You were only protecting your children from a vicious, murdering fowl! "

Pretty crazy. A coworker of mine grew up in Port Aransas, TX and he said one time at lunch we and a few buddies went to the beach. They found a dying or so he says seagull and they put it out of its misery. Well somebody talked or saw them because police pulled them out of class. They didnt do anything though

You can let them know if they need a few thousand they can come and get them at any WallyWorld lot within 50 miles of Michigan City IN. Then if they still don't have enough any other fast food joint only has them by the dozens.

the real question was were the seagull and crow at peace with each other?

Did they make a deal to divide up the doves without drama? if so, this incident only awaits a Papal spin doctor to work his magic

In South Bend IN they have had a pair of mating Peregrine Falcons that help with controlling the Pigeon population. That is one of if not the fastest species on earth, and have read it is an amazing sight when one of the Falcons goes out to grab a bite to eat.

Toward his defense, perhaps he ought to involve the restaurant with a claim of not adequately protecting the customers from wild life and not posting a warning sign that wild life may be around and aggressive. In my City there is an ordinance that defines pigeons poop as a harmful vector for disease and also the roosting spots. This has to do with residential buildings. Its the building owner's responsibility to clean and remove birds etc.

So your local health code may have a provision that underscores the health hazards of birds' droppings and bird 'scales'- 'dandruff' etc.

Now if your nephew swatted the bird with a baseball bat, that may be undo force...

My mother came to visit me in the Bay Area a few years back. We went to Alcatraz among other spots. While waiting for the ferry we got some fish and chips and a stand and as we walked away, a seagull dive bombed her meal and snatched a piece of fish out of her basket. It happened to quick to swat at it.

The story you tell is incredible. In many urban spots, seagulls aren't much different from pigeons, which have no protection - they can be killed like rats. Up in Washington state (many other spots as well no doubt), the large landfill dump sites have huge colonies of seagulls living seemingly year round.

Cape May is at a crossroads for bird migration. Every spring and fall, thousands of migrating birds pass through the area. Subsequently, birders from all over the world have flocked to Cape May to witness the migrations.
Happened right here....although the vid is old, it's probably the same eatery seen at the start of this clip.

wow. Guess im never going there, ive actually killed 2 seagulls with an F150, and was happy as can be that I managed to do that. Damn sky rats

Yeah, well F the owner I say. Seagulls are not in danger, and sounds like your nephew reacted in spontaneous self defense. Seagulls take their risks in getting food like every other species. Sometimes it goes badly. Oh well, the species carries on.

Another seagull story. In '93 I spent the winter framing a house on Perkins Lane in the Mangolia area of Seattle. It's a sought after address in Seattle as it's on the beach, well, up a navigable but semi steep hill from the beach, and most parts of Puget Sound have a rail line right on beach as it's the only flat spot to be had. But Magnolia is a bluff, the rail line passes between it and the rest of the mainland so Perkins Lane has quite, unobstructed beach views.

Anyway, we'd eat our lunch on the deck and early spring, IIRC, we started see a few bald eagles just in front, over the water. One day a flock of seagulls was harassing an eagle in the air, dive bombing it, making a huge racket. I'd never seen the like of it before but I swear it was happening. We were all incredulous, spellbound, and then at one point the eagle caught one of them in his talons, they both did a slow flutter down to the water's surface where the eagle dipped his beak into the seagull's chest and started chowtime. This according to one guy who had binoculars. F with me, will ya . . . (said the eagle).
