How do you deal with a grossly not as described vehicle bought on ebay?

Hello, I decided to buy a truck on ebay to replace the one I flew to vegas to get, and was rear ended in utah bannanifying the frame totaling it...

01 Dakota, 4 door, automatic, 95k miles, 4wd, "not one mechanical flaw"
I buy it, have it inspected (few minor oil leaks show up, but whatever nothing major) and pay for the remaining balance and shipping...

Truck shows up... So, it was a plow truck... Holes in the roof, fenders, and lots of extra wires and stuff under the hood for the plow... Small amount of play in the ball joints (but it's a dodge so...) the brakes stick and violently jerk the truck when the rears decide to kick in... And the front driveshaft is broken... And the "minor leaks" turn into it's dripping 1 drip an hour out of the back of the transmission between the tcase and transmission.

I tell the seller I understand it's a 14 year old truck, but a broken driveshaft is unacceptable when advertised as "not one mechanical flaw" and I can overlook the other flaws, but, I'm not paying one penny for the driveshaft, and that the leak is horrible and we should do something about it.

He says it's not his problem "my" inspection missed those issues. I called the shop asking WTF, and they hang up on me. "4wd opperating properly" box is checked on the "inspection" form. I send that and a local mechanics quote to my cc company, chargeback the $89.99 I Paid for apparently nothing. Seller tells me in colorful language that I wont get one penny back from him.

Ebay says because it's more than 9years old theres absolutely nothing they can do. I counter with "what if the seller said the truck was a blue ford and it shows up as a white dodge" They say it's between me and the seller.

WTF am I supposed to do? Driveshaft is $680 to replace, seal is $18, fluid is $80, and labor is $600... Nevermind the other used vehicle crap.

Am I wrong for wanting a partial refund to cover the driveshaft and part of the leak? Should I excuse the seller because "he's not a mechanic" and he didnt "think" there was a mechanical flaw of any sort?

Ugh, just wondering.
Thanks
~Nate
