Rental car companies scamming?

Recently rented from Hertz at Sea-Tac airport. Generally a bad experience but my question is specific. We rented a Mitsubishi Mirage. Fuel tank capacity is 9.2 gallons. Since I was unhappy with the service I looked over the contract today and noticed that it lists the fuel tank capacity for that car as 14.5 gallons. This means that if you purchase the fuel option in advance you will be charged for 5.3 non-existent gallons. I wonder how often this scam is occurring. Has anyone here checked the listed capacity on a rental contract with the actual capacity of the fuel tank? Multiply that 5.3 gallon fuel cost times thousands of contracts and Hertz is stealing a lot of money.

The fuel tank option in general is a known scam. I always decline, and just return the car full when done

True enough but people do purchase it. But the person who doesn't and returns the car empty could still be charged for 5.3 non-existent gallons since 14.5 is the stated capacity. Who actually checks that number?

Hertz has 615k cars. If only 10% of those rentals result in a fuel overcharge of 5 gallons it would be a substantial sum of money. If the overcharge occurs when a car is returned empty when it should have been returned full, Hertz charge $9.99 per gallon of fuel. I don't know what they charge if you buy the non-existent fuel at the get go.
