Pepsi, where is my jet

I had never heard about this till I ran across it on Netflix looking for something to watch.

In a nut shell, a 20 yr old kid named John saw a commercial on TV from Pepsi that was a points for product campaign. The catch product was a Harrier jet...... 7,000,000 points. There was no disclaimer. The rules said you could buy points at $.10 a point as long as you turned in like 18 points or something tiny like that. So John had a financier friend who ponied up the $700k to win the jet.

I have not finished the series so I am not sure how it concludes and I am not going to cheat by looking it up. I assume he did not get the jet but I am curious how much John gets in the end.

Im not much of a soda drinker. I'll drink something with caffeine when I drive but thats about it. I know I am going to cross Pepsi off my list of drinks.

Well, that sucked. I agree with the person who said it was a corporate decision from a corporate judge. The decision was BS. Should have worn a helmet? Seriously lady? Thats one of your take aways?

I wasted several minutes that I'll never get back skimming through the opinion. I agree, there was no way in hell that was an actual offer. It was whimsical. The fact that somebody ponied up 700k on that effort was incredible.

Either way, I would advise against drinking Pepsi Cola. And the others as well.

It was not intended to be real, legally it was real AF because there was nothing in the ad or the small print that said it wasn't. Had the marketing people listened to te lawyers, it would have been fine but marketing thought they knew better.

Pepsi lucked out and got a sympathetic judge.

Before dropping that sort of coin they should have obtained confirmation from Pepsi that the supposed offer was actual.

Legally, since there was nothing on any of the literature saying that it was not real, the assumption is that it is real. That is why these companies have staffs of lawyers to go over everything in order to make sure there are no loo holes or back doors that cn bite them in the ass.

Had the add been run as originally planned, there would not have been an issue. The original ad had 700,000,000 pt for the Harrier jet. That would have been $70m for the jet that only costs $32m. Not worth it. The ad folks wanted it to look easier to the eye so they kicked a "0" off, made it 70,000,000 pts or $7m. Unlikely someone was going to pony up $7m but still a good return to get a $32m jet. Ad folks still did not like it so they dropped another "0".

Since they put no disclaimers the offer is legitimate. Since they allowed, by the fine print) for people to buy points at $.10 a point, the consumer did so and filed his claim to get his prize.

I suspect they knew that Pepsi screwed up, just like they did in the offer in Asia years earlier. That is on Pepsi. I guess they assumed Pepsi would make a legitimate offer instead of offering 2 cases of Pepsi on the first offer and then $1m on the second offer.

The judge made a BS ruling and let Pepsi off the hook even though its clear as day that they screwed up and made a legitimate offer.
