Don't get ripped off like me!
 
I have gotten so much help from this site, that the thought of someone else getting ripped off like me, and that I could of stopped it, is over whelming. Do not purchase anything from Keith Joiner, MRBENZ@BELLSOUTH.NET, it has been two months since I pay him for a trunk floor mat, and he will not answer me or paypal. I do not want to start a long debate with anyone, just to inform. Thanks Dairel

what is his handle on this board? I've noticed a lot of posters in the "For Sale" section who are sellin' stuff...but their # of posts are very low...they may be only on here to sell stuff...and nothing more...not a regular poster...

I have read that it is not good to do business with a site which does not list a physical address.... and I could not find one on this site....
Maybe a letter of complaint to the FTC... or whatever handles INterstate Commerce ?
Check to see if PayPal has some other functions.. like insurance... What are they good for if they only act on one end of the deal ... ?
If you have a lawyer send a request for the physical address of this guy... Paypal may send it to you... they have one , you can count on that.....

Ok,, he is in Florida... send a letter of complaint to the Florida Attorney General's office.... attn consumer complaints....
Then send all you have to the Florida Taxing authority asking for his address..... His business should have been registered in his name and a " doing business under".... and will have a physical address... When you have a physical address you find the name of the local justice of the peace.. and get the papers to file an action in small claims court... but you register the complaint there and send a letter of demand.. which usually requires you give him 30 days to comply....

From what I am gathering from dairel's post, he did NOT know this guy was running a commercial operation with a website and everything...I am guessin' he got the advertisement for the trunk mat from the "For Sale" section of this forum, which does not allow commercial posters...so I am guessin' dairel just thought he was doin' a friendly transaction between two normal M-B owners...one of which was sellin' his trunk mat...unless this "Keith" is completely new to the Internet/forum scene, which I suspect he is not, he should know that commercial posts are not allowed in these sorta enthusiast forums...so from the beginning, I doubt this guy's intentions were "good"...

Dairel, have you filed a complaint with Paypal? The help section only has info for sellers that I can find, but you can send a question in the help section.

Spock, are you a commercial vendor posting in the parts forum? Someone should turn you in ;)

I did not know that he had a web site, I made my contact with him thru e-bay, I do not know if he is a member of this forum or not. I just know that he will not answer me and that he has not answered paypal, and I did not want anyone else to get ripped off. Thanks for the suggestions Dairel

Hi dairel,

Sorry for the trouble this fellow has caused.

Questions:

Did you buy the product through an Ebay auction?

If so, negative feedback is in order. If not, you can probably forget the legal stuff as it's going to cost you more in fees than the mats are worth.

The good news is that you are not out of luck. Remember, most people take some pride in their reputation -- sometimes perverse pride, but pride nonetheless.

Okay, here's what I would do:

First, do not talk about a lawsuit. At this level, that's bush-league and he'll know it.

Send him a certified letter explaining that he has 10 days to either send the merchandise or a refund via Paypal. If he does not do so, you will contact the State's Attorney General Office, the local District Attorney's office and (the best one of all) the local investigative TV news desk. (Do the research on which station has the most aggressive reporter.)

Then follow-through on this plan if the fellow doesn't reply.

Oh, you might add that you will hire a young adult to carry a sign of protest in front of his house saying exactly what happened in bullet points The headline might read: Kevin Joiner Doesn't Deliver. Come to think of it, hire a cute blonde to hold the sign.

That will get him going:-)
