Can you believe what my neighbor did?

This happened a week ago and it is still bugging me. Last Sunday he drove his van and trailer w/ boat diagonally over my driveway and side yard. The yard was extremely wet at the time, and now has ruts in it.

The next day I put up a temporary fence to reinforce the point that I did not want him or anyone else on my property. (His kids and dogs have been a problem for 6 years). The fence was in line with my back yard fence, which was 4 inches on my side of the property line.

As soon as he got home, my neighbor went over and ripped out the fence! He even threw one of the posts as far as my driveway. I saw him shortly after that and he said to me "If you put it up again I'll knock it down again."

Can you believe this guy? If somebody put up a nasty orange fence like this next to your house, wouldn't you try to apologize and make it right? Instead he chooses to escalate the situation.

Here are pictures that I took the next morning of the fence after he knocked it down. Be warned, these are huge. Don't try this on a dialup!

Put up a permanent fence that conforms with your codes and covenant. From the looks of his yard it will improve your view!!

Oh man...time to sue his monkey ass!

Honestly, if he pulled something like that (take down my fence) I would get very angry...and trust me, you don't want to see me angry (-The Hulk).

I take it the guy is bigger more intimidating than you no? Because of that, he thinks he can bully you and do what he did. I say, go and get a real fence, anchored down into the ground, and if he does it again, take it to court.

Also check w/ your city hall see if it's ok for you to put the fence up, what kind of fence etc..

I think that usually when you put up a fence, you have to agree w/ the neighbor, im not sure.

at least where i am, city hall has to give you a permit for a fence. neighbors have nothing to do with it. in fact, the tallest fences can be put up between neighbor's properties. they usually want you to put up a lower one where obstructing a view of say a driveway or adjoining street could pose a safety hazard (usually in front). you will only need the neighbor's input if you are requesting a variance...

First I would like to say I’m sorry for sending my old neighbor to Tampa I had a similar problem with an absolutely crazy old man that screwed with everybody in my neighborhood.

First, of course I would offer him a beer and talk about it man to man, but this may not be an option.

Second, I would erect a NO TRESPASSING sign and take a picture with some sort of date stamp like a newspaper. When he crosses it call ol’ five O and let them straighten it out. At least you will have a captive audience.

Have you thought about throwing a bunch of nails out in the yard in this area? You could always put a junk car on blocks in this area.

Interesting. I have a neighbor who won't let me drive over his grass to park my boat he just keeps working on those damn Mercedes. He's Screwing up the neighborhood, OK just kidding.

I would

First
Fill out a police report. Have the Police officer talk to him. You don't want to get into a fight with this guy. Let the police tell him your not intending on pressing charges, even though you could, but that they ask him to respect your property.

Second
A fence would probably not look very nice coming from the corner of the house to your front property line. So I would place some large boulders in with the new landscaping that you would be installed in that area. Don't spend a lot of money on the bushes, he could spray Roundup on them one night. I would expect some kind of retaliation from this guy since he already has. If he does kill them, another Police report.

Third
Protect your cars property etc. Again expect some kind of retaliation. If that does occur, another Police report. You will probably now have enough for a civil law suit.

Fourth
Be careful. Does he own any guns???? This idiot may consider using one because you have pissed him off.

Again I would consider the landscaping and large boulder setup to be the best resolutioin. If the boulders are about 1-2 feet in diameter placed about every 2-3 feet, he won't be able to get his truck/trailer around them. And when the bushes grow up nicely, You won't be looking at his mess. The landscaping may cost you a 100 bucks for bushes and mulch. Depending or where you live the boulders may be cheap and the plants will grow very fast, unless treated with Roundup.

Wait until he's asleep, sneak over to his boat. That boat, being a Mastercraft, I'm bettin' that there are some very expensive O'brien waterskis in there. Take several of them and stick them into the ground like fenceposts! Then, with a large airstapler , reattach your construction webbing! Grap a pot of coffee and a large caliber handgun, sit back and wait until he sees it!! The expression on his face will be priceless. Of course you may have to shoot him but at least it'll be in self defense!
But then again.....nah.......just put up a fence.

I'm loving this. Keep 'em coming. This was more or less just a rant about the guy's behavior. I have the situation in hand for the moment and I'll post some more details later. Some comments on your comments:

I've tried parking my POS Jeep pickup (too embarassed to list in my signature) in the way but it's not big enough to do any good. I'm not risking any of the german cars. Oh, and now that I've acquired the 240D, the Jeep is parked in the back yard so as to avoid making the house look like a junkyard.

Boulders are not native to this part of Florida. I wouldn't even know where to get them.

I like the idea of making a fence out of their skis. Unfortunately, they don't own anything even worth ruining. I'm just trying to bide my time while the termites chomp away at their house. It shouldn't be more than a couple years before the whole darned thing comes tumbling down.

I sometimes wonder what my neighbors think ($250k+ neighborhood) when they hear the air compressor and pneumatic tools (I love the way a 1/2" impact wrench sounds early in the morning) start up at 8 am on weekend mornings. Now I am getting an idea about what the wife is referring to.

Oh yea - we got boiled peanuts and just throw the hulls on the ground.

These things I like to solve with a calm persistance. In my case it was kids with ATVs tearing up my property. It involved them tearing down some POSTED signs and blocking posts. My idea of persistance was to put something back up stronger as soon as I could, and do a better job of marking the property. I'd also stand outside and watch the kids when they approached with the ATVs.

It also got to the point of them sawing up a few trees I had cut down in the back of the property as roadblocks. So, I just put up more signs and threw more brush back in the path. They got tired, probably were causing problems elsewhere, and the ATVs seem to be mostly gone this summer.

I think your neighbor probably realizes he over reacted in tearing down your temporary fence. He might feel he has a point in that this type of fence may not be "approved" by your homeowner's association, etc. There will be no consideration on his part that the idea is for him to stay off your property. Until you fence your property off properly and rather permanently, this problem will continue. Check with the standards in your neighborhood. I suspect that a nice rail fence with large posts sunk into the ground will do the trick. Make sure the rails are permanently nailed into the posts so they can't easily be removed.

Then you need to take lots of pictures, including the NO TRESPASSING signs. Also take dated pictures of all four sides and the tops of any cars left outside (a natural target of retaliation). My property has a video camera on it tied to the Internet. It can be set to send a snapshot to your computer (local or distant) at just about any time interval you would desire. You could easily store a picture every minute during the day and have it as evidence should you need to collect for fence damages. I have mine mounted inside to prevent theft. They are becoming common and I can find a link for you if that sounds interesting.

The idea in any potential legal dispute is to keep good notes (day & time stamped) of what happens, take pictures, and keep your mouth shut.

A permanent fence in keeping with your community standards carries a lot more weight (legally) than the hastily prepared orange construction fence. Especially for someone who does not want to take the hint.

i'd set up a camera. and put up another fence. if he tears it down again then u have evidence that he is messing up your stuff. can't have people disrespecting you man.

i'd go up to his house and tell him "i know where you live buddy"

anyways yeah i't put up something and catch him red handed. then u can get him in trouble.

If you went up to him and politely told him that the trailer has left tracks on your front lawn, maybe he will apologize and help to have the damaged area seeded? No need to erect fences and signs, or call in the police...these matters can be settled in a civilized manner...

I'd put a strip of little perennials on your side of the property line. Nothing fancy, just a 6-8" wide swath of colorful flowers that don't grow more than a foot high. It's not as obtrusive as a fence but will show tire marks better than grass does. Plus crushed flowers might build sympathy for your cause.
