Need Advice....Friend crashed my car.......
Hi...
I need an outside opinion here....I went out of town, I asked my neighor/friend to move my car down the street in front of my house...She didn't even have to start it, just roll it!...anyway, I live on a hill and she took the brake off before turning the wheels, and it went up the curb into the Wall!....She said she'd pay for the body damage..didn't want to go through insurance because she would get points on her record. We went to my Body shop guy today, who is Very reasonable...and he said he would do it for $800 (If it went thru insurance he said it'd be $2,000)....So she said fine, but she feels sick about it, that she was trying to do me a favor... Now I'm feeling bad....Should she pay the whole thing because she crashed the car and was Stupid enough to release the brake...Or should I offer to pay half, since she was Trying to do me a favor?....I don't know, what is the right thing to do here??? Linda, I think you shouldn't make her pay anything. She was doing you a favor. If the situation were reversed, what would you do?

I hate to say it, but I agree. You chose the wrong person to help you. Live and learn.
Now if she had borrowed the car and crashed it, that would be a different thing altogether. This is not the Benz you just bought, is it? |

I agree...had she asked to borrow your car and caused the damage, that would be another story.
If you asked the neighbor kid to do it, who would be considered the responsible party in the event of an accident?

Thanks for the reply....I will consider this, yes And no, it wasn't the benz, it was Emily, my beloved VW.....If it was the Benz I'd be writing while jumping off the bridge..... Linda |

Linda, If you do let your neighbor pay for the repair, will she be responsible for keeping that fender washed and waxed? Just a mean spirited thought.

From a legal standpoint, you have to look at consideration.
What does she get out of the deal by helping you move your car? The car was not blocking her driveway, she is not getting paid for it, she is not getting anything in return. You should pay the bill. You asked for her help. Lets face it, its only a little money and its only a car. Period. Money and cars are replacable. Friendships are not as easily replaced or repaired. If i was your friend, i will pay you $800 BUT the next time you ask for my help or go hang out, etc. forgive me for not assisting you. The door swings both ways. Thats just my 2 cents |

She's been a good friend..ok, you're right...BUt she tends to Drink, and I bet she was when this happened...BUt live and Learn..A little voice inside told me I shouldn't , but she got offended when I suggested maybe she should not try and move the car......I guess they call it an accident because it was one.....
