A Ridiculous eBay policy!

Okay, let's say I want an item on eBay but I forgot to bid while it was still running. The item recieved no bids, thus no winner. So I email the seller and ask to purchase it OUTSIDE of ebay, so we don't have to wait another 7 days and he doesn't have to pay to relist.

THAT'S against the rules!!!!

Basically eBay forbids sellers to sell items to people if they were ever listed on their site.

Here's eBay's explanation. What do you think?

Offers to Buy or Sell Off-Site





eBay prohibits email offers to buy or sell listed items outside of the eBay site. Offers of this nature circumvent eBay's fee structure and are a potential fraud risk for both buyers and sellers. Some examples of off-site offers include:

Using information obtained through eBay to offer to buy or sell a listed item off-site.
Canceling a listing to sell to a buyer who became aware of the item through eBay.
Ending a listing early to sell the item at a higher price to the winning bidder.
Offering to sell an item to a bidder in a Reserve Not Met listing.
Offering to sell duplicate or additional merchandise underbidders.

It is acceptable for sellers to end a listing early in order to sell an item at the current bid price to the high bidder. Bidders are permitted to contact sellers with requests to end a listing early; however, sellers are under no obligation to do so.

Although off-site offers are not permitted, sellers may be able to sell items to underbidders by sending a Second Chance Offer.

sod 'em. I've done it, and I'm still alive.

ebay is so successful now they're tightening up and raising fees etc. they just want more $$ out of you.

The seller can re-list the item with you as the only authorized bidder - then you submit a private offer for an immediate sale without anyone else getting a chance to bid. This gives eBay their fees and the buyer some protection.

I found that there is not that much buyer protection.

I bid & won some porsche parts at a good price, but the buyer refused to honour the sale. He said he had emails from other buyers who couldn't get their bids through - i.e. a problem with ebay on the technical side. This may be true, it may be false. Anyway, ebay say they cannot force a seller to sell, yet they say when you bid that 'this is a contract'. Which is it?

we did that when we bought my integra. Saw it on ebay and bought it from the dealership before the auction even ended.

You got it totally right, that policy is there in order to help ebay earn more money through the listing & final value fee that they'd receive on the item, that they'd be losing if things were sold more often "off the cuff" so to speak. But they still manage to get themselves a cut because many times the "off ebay" transaction involves Paypal (an ebay company), and paypal takes a portion of the money being exchanged between the buyer and seller anyway.

Point being, ebay is making out like a bandit!

since you are able to contact the seller via ebay's messaging system, i think that is how they enforce this contract. they keep seller emails hidden.

If a buyer wants to make me an offer after a listing has expired, how can e-bay claim breach of contract or damage, since my contract with e-bay has technically expired and e-bay has obtained its fee. If the interpretation is as the original poster suggests, no seller would be able to operate a regular retail store or business that takes online sales, despite the participation of Dell, IBM, Krusse, etc. The terms that I saw posted in the original message appears to be limited to active listings, not expired ones. This appears to be much ado . . .
