Cruise aint cruisin

Hi, I have a 1987 300E with 142,000 miles on it. I recently purchased the car from a mechanic and he gave me a 1 year warranty on the newly rebuilt transmission. When I am on the freeway and try engage the cruise control the car seems to sort of lurch forward and then back as if the cruise control is catching and then slipping. My question is could this be related to the transmission in anyway so that I can get the work done at no charge. Thanks for any help.
