Unhappy 98 E320 starting problem

About 20% of the time, after turning the key FOB the engine does not crank. But if I turn and hold the key in the start position for 3-5 seconds sometimes the engine starts but not all the time. In two occasions a “recharge battery” message was displayed. But it can not be the battery as I just put in a new MB battery.

So far I have been able to restart the car every time this has happened by turning the key back to 0 position and waiting a few seconds.

Any ideas what the problem is?

S.
