some good points, I'llt ry to clarify as I was completely out of my mind before from shock.
ok. Heres the deal.
The water is from runoff from a house around the corner. There is usually water there, which is why I slowed to 10 mph below the speed limit of 35mph, especially since it is a blind turn, and I know it well enough to know that cars have spun there before causing major accidents. Ins co agrees with me on this. my street is notorious for about 1000 + Accidents a year due to driver mishaps, and or natural hazards.
From what I gathered from the witness, I slowed down for the turn which I had every right to do, the other car came at speed behind probably 40 mph or more, saw me slowing down for the turn, he hit his brakes and started to lose control, nudging me and casuing me to spin. When all was said and done, I was in the curb and he was up against the rear of my car with the drivers side of his car. had there not been mud and water with some oil floating on top, it would have been a minor nudge we would have shaken off and gone our seperate ways. when getting out of our vehicles both me and my passenger, and the other driver could feel how slippery the ground was.
After the accident, several cars, including a new bmw 7 series and G-wagen both came around the turn and almost lost it themselves. The road was muddy, oily, and wet. not a good combo for near any car. Cars going up the street the opposite direction were also losing traction going around this turn uphill.
The reason I wanted to file the police report was so the police would at least put up some flares, to try to slow traffic down. but like I said they just couldn't be bothered, and this was after 4 phone calls by me, and 30 minutes before one even showed up.
I have nothing against the police, but when lives could be at stake and they could care less, that bothers me. I myself have always been treated fairly by the police when and if I have ever been pulled over or had to deal with them.
I have let the police use my driveway to monitor the park across the street on several occasions during stakeouts of supposed drug dealers across the street. I have always been courteous and all.
The problem is that some things are just more important than a fender bender, like a call for help or a real emergency, but I still think they could have taken a minute or two to set up some flares to slow traffic down.
The other driver and myself almost saw our cars get hit seevral times after the accdent from cars coming around the turn, slamming their brakes and sliding towards our cars. they were lucky enough to have been able to get out of the way in time.
My biggest problem that I have right now is the fact I have not been able to sleep more than 12 hours since friday night. I have bad neck, back and shoulder pains, that have kept me awake and not allowed me to sleep or get comfortable.
In fact I can't even sit in a car or chair for more than 15 minutes without getting uncomfortable. That is my main concern, my health. I have a permanent screwed up back from an accident I had over 10 years ago, and it was feeling very good. now It feels worse than it ever did. and I can feel my muscles pulsating all over the show. Really not fun at all.
Everything will work out, so I feel I should end up being all taken care of, as well as the car.
Now if I can convince the ins co to let me order the parts I need, I'll be able to do all my upgrades.
IT does help that my father is friends with the adjuster as he is working on an immigration case for the adjusters friend, and the adjuster should have a check ready for me by monday or so.

And believe me when I say I do not mind criticism at all, as long as it isn't severely harsh. Accidents suck, and I feel bad for the guy that hit me, but I also have to wonder what he was doing ina rental in the first place. I can only assume his car was in the shop for another accident he had. I have been in two car accidents my whole life. both of which were others hitting me. this makes 3, in 12 years of driving. thats a pretty good ratio if you ask me all things considered. Hell my 20 yr old brother has been in several accidents before he was 18, my older brother has also been in about 10 or more accidents in 14 years of driving. and in 50 years of drivign my father has been in maybe 40 accidents or so. With him I'm never surprised. he was in 3 accidents in one week. he got rear ended, he rear ended someone, and he got rear ended again. two of his accidents happened in one day!!! and in those accidents the police filed reports and all and even gave him a speeding ticket, which he got dismissed as he was in stop and go traffic, and there was no way he could have been speeding in the traffic he was in. But all in all, worst case scenario is I'm out my deductible. but my ins co feels that the other drivers ins will be paying out and I will be taken care of and No money out of my pocket.
Man what a hellish last 2 weeks I have had. My computer crashed and I lost everything, which really bites but I am not that upset about it. I have backups of most of the stuff anyway... My water heater broke and flooded my basement, and well you know what happned to my car.
