Driving unlicensed ON PRIVATE PROPERTY is not a crime. Unless the policeman saw the person driving on a public road, they haven't observed a crime being committed.

Many police departments in larger cities have a policy of not enforcing immigration law, and leaving that up to the INS. It's a controversial position. The idea is they don't want people in the illegal immigrant population being afraid to go to the police if they're aware of some other crime that's been committed. Bad things happen socially when you have a large underclass of people who feel they can't trust the authorities.
