I always question it when people say that. Why? Because it can apply to any punishment. As I have always said, you lock up a guy for 10 years and find him innocent, you can't give back those years either. So if you want to go that route with punishment, in general, you still have to face the fact that you are going to punish someone who is innocent. If that gives you the creeps then you cannot punish anyone period.
