A technology is what you make of it. Cell phones can be not carried, switched off, or even (in a lot of cases) have the battery pulled. I find a smart phone rather convenient if I'm in Southern California on the road and I need to SSH into a server to update or fix something.

It doesn't mean I'm using it to post "I'm using the water closet again" to Facebook every five hours.

As far as the Stingray devices ... what's the legality of spoofing a cell tower (these seem to be spoofing devices, not just passive receivers)? What if someone needs to make a 911 call and can't due to the Stingray device -- I'd imagine that the FCC would look cross-eyed at something like that. It's likely in the same category as cell jammers.

Proper way to do this is to get a subpoena from a judge and get the data from the mobile company itself.
