Well I know this, and that is that the one I used I pulled from a 240D at the P & P and it is perfect. Looking through my parts this afternoon, I came up with one exactly like the one you are fussing with. Oh golly me I thought when I dug it up, I didn't think I had any like this. I though it was correct and I was looking for one. So then I crawled under my car to match it up and saw the problem. It is to small and that could only have come off my previous car, a 1985 300D automatic. So the guy you bought that piece from owes you the correct piece. He'll probably be a bit red in the face when you tell him, but that is where the problem is. I do believe some people have used that small piece as is, but use only three bolts and it sets on crooked. Can be done, most people don't see that part when it is installed.
