Your MB dealer should have provided a fresh washer under the plastic cover of the filter whenever you bought one -- it's not wise (though you can get away with it once) to use an old one. Use it, along with the correct torque (always use a torque wrench, too -- I can't tell you how many sad stories I've read (on other lists) of folks who overtorqued their drain bolts and are sorry for it).
