If the modulator was leaking fluid, it's more likely that you'd be asking about hard shifts as opposed to smoke. Anyway, I don't think that transmission fluid can make it to the intake on MBZ diesels.
BTW-What color is that smoke?
FYI-The modulator is on the driver's side on the 722.xxx trannies. You should pull the vac line that runs from the IP to the modulator and see if there's fluid in it.
