John Kerry’s Bodyguard of Lies

NEW YORK -- Winston Churchill often repeated Stalin's observation that "in wartime truth is so precious that she should always be attended to by a bodyguard of lies." And now that the Democratic National Convention has ended with Kerry's acceptance speech concentrating on his four-month service in the Vietnam War 35 years ago, rather than his service during the past 35 years, it appears particularly appropriate.

One of the pesky IRS Code 527 organizations that now buzz through the campaign atmosphere like insatiable horseflies in the aftermath of McCain-Finegold reforms has had the presumption to raise some serious questions about the truth of John Kerry's Vietnam wartime service.

Called "Swift Boat Veterans For Truth," the group has a website, airs TV ads running in key "battleground" states, and has published a book. The conniving and self-promoting lies of the John Kerry it portrays make Sammy Glick look like a rank amateur.

If the incidents it details are true, Kerry was a coward who fled in battle having unintentionally thrown his current supporter, Jim Rassmann, overboard in his panic. Kerry tried to get his first Purple Heart on the basis of a tiny self-inflicted wound from his own grenade. His supporter, Max Cleland, accidentally blew both his legs off and one hand off with one of his own grenades, but never asked for a Purple Heart because, just as in John Kerry's case, there was no enemy action at the time. Kerry went behind the back of the commander who refused his medal request and the doctor who had treated him, and got one anyway.

Swiftvet officers watched this kind of behavior for four months into Kerry's 12 month "tour of duty." Then three of them told him pointedly that he'd better use the three Purple Heart escape clause and return to the States fast. Kerry left the next morning. And those are just a few of charges the Swiftvets are making. It certainly is a very different picture of the war hero than his campaign has been painting of their JFK: John Forbes Kerry -- but this time as John "Flashman" Kerry.

"CONSIDER THE SOURCE" INVITED Kerry campaign spokesman Luis Vizcaino. And last week Marc Elias, General Counsel for Kerry-Edwards 2000, and Joseph Sandler, General Counsel for the Democratic National Committee sent a hurried and semi-hysterical letter warning television stations not to run Swift Boat Vets ads setting out their definition of "the source" It is well worth reading as a reductio of Kerry campaign logic.

"The group is a sham organization," it points out. Yet the Swift Boat Veterans had been organized months earlier with the IRS and Federal Election Commission, just like MoveOn.org and dozens of other 527s, and was no more "sham" than they were. As a matter of fact they had elected to remain unincorporated under the regulation and take the risk of being perhaps the only 527 in which its members were willing to accept personal liability for their actions, unlike MoveOn which had compared Bush to Hitler. The Swiftvets are either very brave or very dumb.

"The advertisement contains statements by men who purport to have served on Senator Kerry's SWIFT Boat in Vietnam… they pretend to have served with Senator Kerry… ." Actually nothing in the ad calls any of the men it cites as being Kerry's crew members. And there can be no doubt they "served with Senator Kerry" in the same Coastal Group 11 at the same time. Worse still, 16 out of the 23 surviving officers and commanders who served with Kerry at the base now claim he is unfit for command, much less to become commander in chief of the U.S. Armed Forces. And the Swiftvets claim to have a total of 254 members who served from Seaman to Admiral in Kerry's Coastal Squadron 1, including several of Kerry's commanding officers and some sailors who had been on Kerry's boat.

"Fake 'witnesses' speaking on behalf of a phony organization…"? Swiftboat service was not a lone wolf operation. Kerry's boat ran in tandem with other Swiftboats who were anywhere from 10 to a couple of dozen yards away, rather like World War II aircraft using formations to protect one another in combat. So the crews and commanders of other boats during Kerry's operations were witnesses all right. They kept a keen eye on anything another boat was doing, right or wrong—particularly since the mistakes of another boat could threaten their own survival. And boat commanders like Kerry, rather than enlisted crew members of his or any other crew, were more likely to have the best understanding of how the mission was being performed by another commander.

"The entire advertisement, therefore, is an inflammatory, outrageous lie"… and should stations run it anyway…"your station is responsible for the false and libelous charges made by this sponsor." Remarkable. On the face of the simple facts recited above, Elias and Sandler may have written the first legal letter in campaign history that actually commits the violations it charges its target with… making "false and libelous charges." It also raises a clear question of tortious interference with existing and proposed contracts between Swiftvets and the stations they had lined up to run the ads.

THEN THERE ARE THE "chilling effect" First Amendment violations of Swiftvets' perfectly ordinary 527 conduct in using its donors' funds to make its point of view heard without supporting a particular candidate. Ironically the real question is, who do Elias and Sandler represent? Who retained them? From their signatures as General Counsel it appears that both are working on behalf of and being paid by the taxpayer-funded Kerry campaign

But to do what? To threaten television stations that they may be sued for libel, purely on the basis of Kerry campaign assertions of false statements by individuals who are likely lack actual malice and were certainly in a position to have relevant opinions, if fallible memories, of events that happened 35 years ago? This is long before Kerry had any professional association with the Democratic Party. Let's assume Elias and Sandler are absolutely correct in their assertions and there is no statute of limitations on this kind of outrageous libel (there is, and it has passed). Isn't this Kerry's personal case to prosecute, not the Democratic Party's?

What if, for example, the Democrats had decided to run commercials based on what they felt was valid information attacking Richard Nixon for getting rich by cheating his shipmates at poker on those boring supply runs in the South Pacific during his naval service 25 years earlier and perhaps running a black market operation on the side out of naval stores at various ports? Should the Republican Party have used donor money to prosecute a case that has nothing to do with Nixon's political service?

Whatever the truth of the Swiftvets charges, they are a credible organization and their members were certainly in a position to have informed opinions. And in their unincorporated 527 status they are easy to sue and they are now on the record. So where are all the lawsuits against them for libel? Imagine the awards John Edwards' trial lawyer buddies can get out of an operation which, according to Al Hunt -- in one of his most embarrassingly often wrong but never in doubt rants, is "significantly funded and directed by Texas fatcats and political operatives."

In the New Republic yesterday, a naif named Kenneth Baer begs the Democratic Party to commence a major lawsuit against the Swiftvets for libel, lèse majesté, whatever. And given the sloppy work Elias and Sandler have done so far, that would be the answer to the Swiftvets' prayers. Wait till those expedited depositions start to leak -- forget the trial. Baer was a speechwriter for Al Gore. He runs "a Democratic consulting firm." The GOP should be so lucky as to have him gain influence.

In the meantime, Dick Morris, John McCain, Bill O'Reilly and others should stop twittering about how rude and crass and dishonorable and counterproductive it is to even explore such nasty possibilities in public and take a look at the charges and supporting documentation brought forth by the Swiftvets. Does it matter whether they are funded by Richard Mellon Scaife, George Soros, or The Tooth Fairy? What does matter in a close presidential election is if there is significant evidence that some or all of the Vietnam service Kerry has elected to make the center of his campaign to move from "war hero" to "war president" is a tissue of lies.

And it is time for the press to look into the charges brought by the Swiftvets. The Swiftvets have depositions, phone numbers, on the record statements, and for all of the innuendo from the Kerry apparatchiks, not one of the Swiftvets has enjoyed a fancy hotel room paid for by the Bush campaign, much less gone on a campaign tour with the candidate. It is easy to see what the nine Kerry crew members are getting out of their 15 minutes of fame. But what's in it for the 254 Swiftvets? It is important to answer that question in considering their charges.

WASHINGTON - One of the authors of a new anti-John Kerry (news - web sites) book frequently posted comments on a conservative Web site describing Muslims and Catholics as pedophiles and Pope John Paul (news - web sites) II as senile.


But as he prepared to launch the book, "Unfit for Command," Jerry Corsi apologized for the remarks in an interview with The Associated Press Tuesday, saying they were meant as a joke and he never intended to offend anyone.

In chat room entry last year on freerepublic.com, Corsi writes: "Islam is a peaceful religion — just as long as the women are beaten, the boys buggered and the infidels are killed."

In another entry, he says: "So this is what the last days of the Catholic Church are going to look like. Buggering boys undermines the moral base and the lawyers rip the gold off the Vatican (news - web sites) altars. We may get one more Pope, when this senile one dies, but that's probably about it."

Corsi, who described himself as a "devout Catholic," said the comments are being taken out of context. "I considered them a joke," said Corsi, who owns a financial services company and has written extensively on the anti-war movement.

In a March posting, Corsi discussed Kerry's faith, writing: "After he married TerRAHsa, didn't John Kerry begin practicing Judaism? He also has paternal grandparents that were Jewish. What religion is John Kerry?"

Kerry and his wife, Teresa Heinz Kerry, are Catholic.

"I don't stand by any of those comments and I apologize if they offended anybody," Corsi said.

The Kerry campaign called Corsi's Web chat postings disgusting.

"President Bush (news - web sites) should immediately condemn this sleazy book written by a virulent anti-Catholic bigot. It says something about the smear campaign against John Kerry that it has stooped to enlist a hatemonger," said campaign spokesman Chad Clanton.

Calls to the Bush-Cheney campaign were not immediately returned.

"Unfit for Command," which goes on sale Wednesday, accuses the Democratic presidential nominee of lying about his decorated wartime record and betraying comrades by returning from Vietnam and alleging widespread atrocities by U.S. troops.

The book claims that Kerry earned his Silver Star not in a barrage of enemy fire, but rather by killing a fleeing Viet Cong teenager. It also questions the three Purple Hearts that Kerry earned, saying that none was for serious injuries and two wounds were self-inflicted.

According to medical records from his naval service, Kerry still has shrapnel in his thigh from a war injury.

"I think it's important the country have the facts about John Kerry so that they can reach a reasonable decision," said co-author John O'Neill, who succeeded Kerry in command of a swift boat. O'Neill also is spokesman for Swift Boat Veterans for Truth, which began airing an anti-Kerry ad last week.

Veterans for Bush

I came to know Lt. John Kerry during the spring of 1969. He and his swift boat crew assisted in inserting our Special Forces team and our Chinese Nung soldiers into operational sites in the Cau Mau Peninsula of South Vietnam. I worked with him on many operations and saw firsthand his leadership, courage and decision-making ability under fire.

On March 13, 1969, John Kerry's courage and leadership saved my life.

While returning from a SEA LORDS operation along the Bay Hap River, a mine detonated under another swift boat. Machine-gun fire erupted from both banks of the river, and a second explosion followed moments later. The second blast blew me off John's swift boat, PCF-94, throwing me into the river. Fearing that the other boats would run me over, I swam to the bottom of the river and stayed there as long as I could hold my breath.

When I surfaced, all the swift boats had left, and I was alone taking fire from both banks. To avoid the incoming fire, I repeatedly swam under water as long as I could hold my breath, attempting to make it to the north bank of the river. I thought I would die right there. The odds were against me avoiding the incoming fire and, even if I made it out of the river, I thought I'd be captured and executed. Kerry must have seen me in the water and directed his driver, Del Sandusky, to turn the boat around. Kerry's boat ran up to me in the water, bow on, and I was able to climb up a cargo net to the lip of the deck. But, because I was nearly upside down, I couldn't make it over the edge of the deck. This left me hanging out in the open, a perfect target. John, already wounded by the explosion that threw me off his boat, came out onto the bow, exposing himself to the fire directed at us from the jungle, and pulled me aboard.

For his actions that day, I recommended John for the Silver Star, our country's third highest award for bravery under fire. I learned only this past January that the Navy awarded John the Bronze Star with Combat V for his valor. The citation for this award, signed by the Commander of U.S. Naval Forces, Vietnam, Vice Admiral Elmo Zumwalt, read, "Lieutenant (junior grade) Kerry's calmness, professionalism and great personal courage under fire were in keeping with the highest traditions of the United States Naval Service." To this day I am grateful to John Kerry for saving my life. And to this day I still believe that he deserved the Silver Star for his courage.

It has been many years since I served in Vietnam. I returned home, got married, and spent many years as a deputy sheriff for Los Angeles County. I retired in 1989 as a lieutenant. It has been a long time since I left Vietnam, but I think often of the men who did not come home with us.

I am neither a politician nor an organizer. I am a retired police officer with a passion for orchids. Until January of this year, the only public presentations I made were about my orchid hobby. But in this presidential election, I had to speak out; I had to tell the American people about John Kerry, about his wisdom and courage, about his vision and leadership. I would trust John Kerry with my life, and I would entrust John Kerry with the well-being of our country.

Nobody asked me to join John's campaign. Why would they? I am a Republican, and for more than 30 years I have largely voted for Republicans. I volunteered for his campaign because I have seen John Kerry in the worst of conditions. I know his character. I've witnessed his bravery and leadership under fire. And I truly know he will be a great commander in chief.

Now, 35 years after the fact, some Republican-financed Swift Boat Veterans for Bush are suddenly lying about John Kerry's service in Vietnam; they are calling him a traitor because he spoke out against the Nixon administration's failed policies in Vietnam. Some of these Republican-sponsored veterans are the same ones who spoke out against John at the behest of the Nixon administration in 1971. But this time their attacks are more vicious, their lies cut deep and are directed not just at John Kerry, but at me and each of his crewmates as well. This hate-filled ad asserts that I was not under fire; it questions my words and Navy records. This smear campaign has been launched by people without decency, people who don't understand the bond of those who serve in combat.

As John McCain noted, the television ad aired by these veterans is "dishonest and dishonorable."
Sen. McCain called on President Bush to condemn the Swift Boat Veterans for Bush ad. Regrettably, the president has ignored Sen. McCain's advice.

Does this strategy of attacking combat Vietnam veterans sound familiar? In 2000, a similar Republican smear campaign was launched against Sen. McCain. In fact, the very same communications group, Spaeth Communications, that placed ads against John McCain in 2000 is involved in these vicious attacks against John Kerry. Texas Republican donors with close ties to George W. Bush and Karl Rove crafted this "dishonest and dishonorable" ad. Their new charges are false; their stories are fabricated, made up by people who did not serve with Kerry in Vietnam. They insult and defame all of us who served in Vietnam.

But when the noise and fog of their distortions and lies have cleared, a man who volunteered to serve his country, a man who showed up for duty when his country called, a man to whom the United States Navy awarded a Silver Star, a Bronze Star and three Purple Hearts, will stand tall and proud. Ultimately, the American people will judge these Swift Boat Veterans for Bush and their accusations. Americans are tired of smear campaigns against those who volunteered to wear the uniform. Swift Boat Veterans for Bush should hang their heads in shame.

Mr. Rassmann, a retired lieutenant with the Los Angeles County Sheriff's Department, served with the U.S. Army 5th Special Forces Group in Vietnam 1968-69.

So...Corsi making some "humorous" comments in admittedly poor taste and for which he has apologized is enough to discredit him? He's the co-author, not the veteran. Oh, and Chad Clinton's like some rational person with no political agenda? Panic in Kerrytown?

As far as FactCheck goes, whatever. None of this would matter had Kerry not made Viet Nam the MAJOR focus of the campaign and the focus of who he is and why he's the right man to run the country.

Moveon.org and SwiftVet are both 527 (or is it 529?) organizations. Moveon usually gets a free pass and can take tons of cash from Soros. Swiftvets get $100K from some guy in Texas and they're a "republican" shell organization. You know, I don't recall SwiftVets comparing Kerry to Hilter (or Nevill Chamberlain for that matter).

What I love so much about liberal hypocracy right now is that it smells like panic.

"Dickie" Morris is a sellout rightwing whore.

It costs way more than 100k to produce and buy TV time they way these guys are doing. They got big smear money behind them, from the usual Scaife crowd who specialize in smear, and slander and have gone after anyone who has opposed Bush with this disgusting crap for the last two elections.

After looking at the poll numbers today, there isn't much to panic about. My favorite is Foxnews approval rating on Bush, down to 44% from a news organization that usually pads his numbers by 5%. The only people panicing are you guys - you put this stuff out there because 40 yr old crap is all you got. Look at the present, and it is a disaster for you guys.

And what specifically would be your objection to moveon?

You mentioned that they have recieved donations from Soros. Has Soros engaged in any sweetheart deals with Democrats, like say, Sam Wyly did when bush privatized the Univerisity of Texas endowment fund and sent 90 million dollars to Wyly's Maverick management group?

The same Sam Wyly who ran false smear ads against McCain to the tune of 2.5 million bucks.

was moveon founded by a Texas Oil and Gas Lawyer who got a supreme court clerkship after being Nixon's attack dog and who's law partner ran for Lt Gov of TX with Bush? Or who's other law partner is a Bush appointee?

and coincidentlally the communications director for SBVFT was married to the law partner who ran with Bush. And she was an advisor to Ken Starr.

Your hitting it right on the head. The whole thing is being met by the public with a big ho-hum, and Bush's refusal to condemn these guys has left a perception that he is unable to offer much on current issues, so he'll indulge in this crap instead. On Larry King last night, he again went into his refrain about how he inherited a bad economy from Clinton, seemingly oblivious to the fact that most people are wondering how something from three years ago has any bearing on the mess we are in today, and WTF has he been doing about it? The whole rightwing crowd, and our posters show it, is looking out of touch and stuck in the past. Kerry is pretty clear on what he would do on the war on terror - build more international cooperation and abandon the me-so-tough posturing of these nuts. We are not dealing with an enemy on a battlefield - they are like an octopus with tentacles in every country, and we need cooperation with them to stamp it out, not chest beating and a neo-con nightmare in Iraq that has nothing to do with the problem. Bush wants to "stay the course". What course? He doesn't seem to have one.

What's the latest on this thing? I heard that another of the Swiftboat Vets was "outed" in that he previously said nice things about Kerry and has now changed his tune.

Any more? Has Kerry released any records as they've demanded?

Its starting to get into the mainstream. Most of the time the reporters seem quite a bit more interested in finding-out about funding than finding out about the accusers or whether there is any "there" there. I figure if it churns for another few days that real journalists will begin to check it out and we'll find out how much truth there is to that stuff.

I'm still thinking that the vets are confusing extreme anger toward Kerry's post-Vietnam wholesale, unfocused accusations about the soldiers, sailors, airmen and marines (justified, in my mind) with Kerry's actions in combat.

By actual contemporaneous accounts, he was a pretty brave guy. By bitter old guy's memories, he was not much. It will be interesting to see how this shakes out.

One guy, Thurlow, who's spiel has been that Kerry was not actually under fire when he pulled the Green Beret from the drink, has been compromised because CNN obtained his own Bronze Star commendation for the same incident, and that cititation describes the incident exactly as Kerry and his supporting crewmates describe. The other guy, Elliot is under fire because he has changed his story several times, and now a new story has appeared from an old article several years ago where Elliot talks about what a great guy Kerry is. The rumor is that that the Swifty's new ad, to air tomorrow, will accuse Kerry of a self-inflicted third purple heart, the one that got him out of Nam.

They have been getting traction with this, but things are starting to look like their may be blowback on Bush. We'll see how this plays out. Chris Matthew has been doing a real number on these guys, and the rest of the liberal press smells some blood in the water. A lot of these swifties actually have very little to stand on documentation wise.
