Its pretty discretionary here, but with that much, I promise he would be charged with a felony just on the aggregate weight. I have a case like that now I represent a doctor's kid who is a student at a very expensive college. He bought two oz in 1/4 baggies from a guy that was selling out of a drive through restaraunt window. This kid drives a $40K vehicle, had $6K in his bank account when busted (allegedly ran a stop sign, had it sitting in the car in plain view, plus the cop could smell it), has good grades and the money is forensically traceable as coming directly and entirely from his father. He had no cash to speak of on him when he was busted, no empty baggies in the car, ect.... He bought 2 oz at the time, so he could keep it in his freezer and wouldn't have to risk getting busted by exposing himself to multiple buys of smaller amounts:silly: He is charged with felony possession with intent to distribute. I think they will have a hard time proving intent to distribute, but probably are bluffing so I will offer to plead him to "possessing more than 30 grams but less than 250", which is still punishible by up to 1 year in jail and $1K fine, whereas as currently charged as a felony, subjects him to up to 3 years and $3K fine.

There's a story that has been posted here many times about a 300TE or 300DT that runs back and forth across the country on hemp oil.

Nelson cited for marijuana possession

LAFAYETTE, La. - Willie Nelson and four others were issued misdemeanor citations for possession of narcotic mushrooms and marijuana after a traffic stop Monday morning on a Louisiana highway, state police said.

The citations were issued after a commercial vehicle inspection of the country music star's tour bus, state police said in a news release.

"When the door was opened and the trooper began to speak to the driver, he smelled the strong odor of marijuana," the news release said. A search of the bus produced 1 1/2 pounds of marijuana and 0.2 pounds of narcotic mushrooms, according to state police.

Nelson's publicist, Elaine Shock, declined immediate comment.

Also cited were Tony Sizemore, 59, of St. Cloud, Fla.; Bobbie Nelson, 75, of Briarcliff, Texas; Gates Moore, 54, of Austin, Texas; and David Anderson, 50, of Dallas.

Each was released after being issued a citation.

Nelson, 73, has recorded songs including "On the Road Again" and "City of New Orleans."

Depending on the cop, it still can. Heck, I brought my parents home from the hospital a few months ago and my dad left a bottle of prescribed valium in the car. I didn't know it was there, but the cop that pulled me over for driving too slow(it's a long story, I don't have depth perception) one night found it. Well you wouldn't have to drive far to get it, because its grown at Ole Miss. They used to grow it at Clemson too, but even if they still did, I would hate for you to have to drive that far of a returned drive stoned:D

Ain't it the truth. And that Supreme court nominee who was found out to have smoked it in college. Clearly his academic credentials and subsequent legal career was all fraudulent as he couldn't have done any of that if'n he smoked reefer.
