Buying a gun in Texas.

What are the rules for buying a handgun? A rifle? A shotgun?




Anyone got any good information?

If you want to bring the firearm into CA it has to be on “the list” of California legal firearms.

If you have CA residence and a dealer is willing to sell to you, he has to ship it to a FFL in CA from where you can pick it up, after 10 days, that’s the wait time for pick up in CA.

If a friend buys it for you in Texas, he still would have to transfer the firearm via FFL to CA which again is only legally possible if the type/model is on ‘the list’.

When it comes to what CA consideres "assault rifles" the subject gets real sticky, seriously.

In other words, if you have a CA ID a dealer in TX can’t legally sell you a firearm, without shipping it to a FFL in CA, from where you would have to comply with CA requirements, such as background check etc. in order to take possession of the weapon.

If you have a TX ID you should have few issues to buy one legally, provided you fulfill the requirements. It would be registered with the DOJ in TX. If you wanted to bring it to CA, even only for a trip, it better be on the list, if it's not, you're subject to prosecution for possessing an illegal firearm, under CA law.

I know on handguns its a 3 day waiting period. I was going to buy a small carbine at a gun show like the ones used in columbine. I was 16 and my mom was gonna buy it in her name, but they made her wait three days, and the gun show was only 2days. I believe it was because she was born in Japan to non US citzen parents. Thats the only thing I can think of. My dad bought me a Turkish 8mm Mauser at a gun show, and after about a 10 minute backround check on him, the gun was mine.

We may just have a showcase here, worthy of arguments for anti-gun heroes.

Actually you don't. Heres why:

Maybe the laws have changed in Texas since '01 when I left but an "Instant Check" that comes back yes and you can walk out with whatever you want.

The reason you MIGHT have to wait up to three days is if the Instant Check comes back "Wait" This means the gun dealer must wait three days before releasing the firearm. This is so the ATF can do a background check on that purchase as it popped a flag for whatever reason. If the ATF doesn't object within the 3 day period the dealer is free to release, they may also contact earlier and authorize release. If a gun show dealer released in 2 days then that dealer was notified early. Pretty basic stuff.

Regarding purchasing a gun through the so called "gun show loophole" here is the reality. Anyone, you or I, etc. can purchase a table at a gunshow and sell your privately owned guns. This is no different or illegal than any other private sale! Any dealer must hold an FFL. Once you hold an FFL you HAVE to comply with all ATF reg's or end up in the Fed pen. There are also laws on how many guns you may sell as a private citizen without an FFL. Again, Fed pen time for those who get caught.

There is no prohibition of family member purchasing a firearm as a gift for another family member. There is no prohibition of any citizen purchasing a firearm as a gift for another citizen. Knowingly purchasing a firearm and providing it to a felon is a "straw sale" and carries Fed pen time.

Where is the problem?

Apparently you are unfamiliar with Anti-Gun Heroes. However, you only address the aspect of legally purchasing a firearm and left out the issue of legally owning a firearm.

But than again, you may just be right. Wasn't there someone who registered a gun under the name of his unborn child, I mean, gifts to be given?

This my sound funny, but Justin and I were talking about this last night. seems that here in CA where we already have the strictest gun laws, there has been a rash of Obama gun shopping sprees. Justin and I both have some Christmas money left over, and we were both considering guns, as gifts for our selfs. I want a .22 rifle. so we went to 4 different stores looking at them. I saw a 10/22 and a Remington semi-auto .22 thats it! this fear that Obama is going to stop the sales of guns has hit the .22s.

My Mom moved to Texas about 6 months ago. That got us wondering. In a state where Wal-Mart still sells guns. there has to be .22s on the shelf still.

I just wanna shoot beer cans!

Ruger 10/22's are the most customizable 22's there are. It would be cheaper and easier just to buy one at Big5 or wherever. They're on sale around here but post holiday supplies are low.

The Marlins are nice too.
